Оцінка корупційних ризиків, пов'язаних із проведенням перевірок дозвільних документів у сфері поводження з відходами

Abstract

Проаналізовано корупційні ризики, які пов’язані з проведенням перевірок дозвільних документів у сфері поводження з відходами. Зокрема, визначено основні положення норм чинного законодавства, які можуть містити такі ризики, та надаються пропозиції щодо їх усунення. Основними ризиками у зазначеній сфері є недоброчесність державних службовців і наявність дискреційних повноважень. Розглянуто аспекти та правові чинники, які мають вплив на сумлінність державних службовців у разі виконання ними посадових обов’язків. The article deals with the analysis of corruption risks related to inspections of permits in the sphere of waste management. In particular, the main provisions of the current legislation which may contain such risks are defined, and the suggestions for their elimination are given. The main risks in this sphere are dishonesty of public officials and availability of discretion. The analysis of moral and psychological aspects and legal factors that have a large impact on the integrity of public officials in the fulfilment of official duties is carried out, because a public servant always makes a decision primarily based on personal experience, the psychological attitude towards the work, and also basing on personal beliefs and personal social and financial situation. The discretionary powers allow the body (a person authorized to perform state functions) at its own discretion to evaluate the legal fact (the actual composition) as a result, the relationship might arise, change or stop; to choose one of the several proposed forms of reacting on the legal fact in the project of normative and legal act; to choose the measure of public and legal authority over natural and legal persons, its type, extent, method of implementation; to choose the form of powers realization – publication of normative or individual and legal act of committing (keeping from committing) of administrative action; to define the procedures of legal activity including the time and sequence of its implementation; to determine the method of fulfilling of administrative decision. The exclusion (or substantial limitation) of normative and legal acts or related organizational and administrative documents(job descriptions, orders) of discretionary powers, and also the ascertainment of the clear scope and limits of such powers in making decision is suggested as an effective means of reducing corruption risks.
