Стратегія перекладу польського правового тексту на прикладі термінології кримінального процесу

Abstract

Окреслено проблеми, що можуть виникати з огляду на переклад українською мовою правових понять і термінів, які вживаються у польському кримінальному процесуальному законодавстві, визначено найбільш доцільну стратегію такого перекладу з метою забезпечення максимальної ефективності наступних компаративних досліджень. Проведено типологію термінів і понять Кримінального процесуального кодексу Республіки Польща, що піддаються правовому тлумаченню. За необхідності перекладу іноземного правового тексту найефективнішою визнана стратегія, яка ґрунтується на пошуку еквівалентів у рідній правовій системі. In the article the problems that can arise in connection with translation of legal concepts and terms used in the Polish criminal procedural law into Ukrainian language have been outlined, the most appropriate strategy for this translation to ensure maximum efficiency in subsequent comparative researches has been determined. The translation of legal standards is the basis to study foreign legislation, because it allows being familiar with the interpretation of legal concepts, rules and institutions, their structure, mechanism, forms, guarantees, typology; learning the fundamentals of functioning legal concepts, standards and institutions; carrying out the analysis of certain legal concepts, standards and institutions; revealing positive experience of legal regulation of legal relations, formulating conclusions on the conformity of legal regulation to European standards. The rule of law requires a considerable concentration of efforts and linguistic resources to accurately convey the content in a native context and in order that the addressee (the researcher-translator) interpret it according to the intention of the addresser (the standard creator). Not a formal aspect of literal translation should dominate, but understanding of the nature of the concept, functioning of the legal institution (the informative aspect). It is important to consider the contextual factor as a prerequisite to achieve the effect of legal translation. The author has carried out the typology of the terms and concepts of criminal procedural code of the Republic of Poland, which are subject to legal interpretation. If a foreign legal text is needed to be translated, the most effective translation strategy is that which is based on searching the equivalents in the native legal system.
