Ефективність права у контексті ціннісних і соціальних аспектів

Abstract

Розглянуто ефективність права у контексті ціннісних і соціальних аспектів, складність яких полягає в єдності соціально-конфліктного, інформаційного та юридичного елементів. Основним критерієм ефективності норм права виступають соціальні, психологічні та аксіологічні аспекти, які розглядаються в умовах адаптації національного законодавства до вимог Європейського Союзу. Зазначено, що найважливішим завданням правової системи є цілеспрямоване формування національного характеру, національної ментальності і їх адекватне відображення в законодавстві, виховання поваги до права, віри в його соціальну цінність. The legislation of Ukraine, which is developing rapidly in terms of adaptation to EU requirements, should be developed with a clear focus on the efficiency and the rule of law as a social and spiritual regulator, its principles in public life. Efficiency as a phenomenon should be subject to multidimensional, multifactorial study in which major emphasis should be placed on the anthropological, psychological and axiological aspects. The problem of the efficiency of law and the legislation should not only come together to ensure the objectives for lawmaking in the publication of standards and occurring results. Thus the substantial aspect of the problem of efficiency is ignored, it is given purely technical, social indifferent nature. The effectiveness of law is relatively stable and effective influence on mental processes, the internal world, including a system of self-regulation, the set of reasons, ideals and needs, ensuring the effective fulfillment of positive social right o the individual. Speaking about the effectiveness of specific legislative norms, we must say that the most important aspects of it are of anthropological, psychological. In the psychological context the effectiveness of the legislation means their psychological acceptance, solidarity with them, the ability of social norms cause positive changes in the human psyche, its worldview. The effectiveness of the legislation is a social and anthropological value, their ability to initiate and ensure adequate social self-identity. Effectiveness of law in general as well as specific norms of law must be considered in the context of internal personal development, without which external growth and social development are impossible. The effectiveness of law is not the enforcement of certain installations of public policy, which are variable and often opportunistic in nature, it should ensure personal self-realization, creative activity.
