Праксеологічні засади реалізації компаративістсько-імплементаційних процесів у сфері протидії корупції

Abstract

Обґрунтовано, що реструктуризація інституту державної служби є тим важливим чинником, призначення якого – бути надійним гарантом конституційності, законності і правопорядку у конкретній державі. Попри те, що науковцями здійснено чимало досліджень цього багатовекторного феномена, є усі підстави стверджувати, що в юридичній науці досі нема єдиної думки про розуміння цього явища, його функцій, принципів, критеріїв практичної реалізації, а також співвідношення з суміжними правовими категоріями. Встановлено, що на сучасному етапі державотворення України вкрай гостро постають проблеми необхідності пошуку дієвих форм і засобів модернізації апарату державної служби, підвищення ефективності функціонування державно-владного механізму, реструктуризації системи соціально-правового забезпечення державних службовців. Відтак досвід іноземних держав у цій сфері є системотвірною основою вирішення численних проблем, пов’язаних із публічно-правовою аномією інституту державної служби в Україні. It is proved that the restructuring of the state service is the important factor the purpose of which is to be a reliable guarantor of constitutionality, legality and the rule of law in a particular state. Though scientists have made many studies of the multi-component phenomenon, there is every reason to assert that legal science still produced no consensus on the understanding of this phenomenon, its functions, principles, criteria of practical implementation and relationship with related legal categories. It is underlined that at the present stage of Ukrainian public service extremely acute problems of prior importance to find effective forms and means of upgrading the state service system, improvement of the efficiency of state governance mechanism, restructuring the social and legal support for state officers arise. Thus, the experience of foreign countries in this area is system-basis for solving many problems related to public law anomie of the state service in Ukraine. Analytical operationalization of our concepts inherent the organization and functioning of public service and confirms the validity of the thesis that the implementation of international experience in this area, based on comparative and analytical research serves as the basic key to the emergence of a modern, highly effective mechanism for governance activities which prevent the phenomenon of corruption by complex methods of structural mechanisms of the legal and socio-economic types. The optimal model combining all levels to ensure proper administration of the state service in the unity of practical and permanent protection of state officers create effective conditions for the high efficiency of functioning of the state apparatus – a key indicator of a democratic society and establishment of a legal state.
