Принципи діяльності Національної поліції в Україні

Abstract

Здійснено аналіз принципів діяльності Національної поліції, а також спробу визначити інші основи поліцейської діяльності цього центрального органу виконавчої влади, зокрема ті, які не відображені в Законі України «Про Національну поліцію». Ці принципи можуть у подальшому бути важливими для підготовки інших нормативно-правових актів, які регламентуватимуть функціонування органів внутрішніх справ. The Law of Ukraine «On the national police», which was adopted on July 2, 2015, was the cornerstone of the reform of law enforcement in our country. For a long time scientists working on various bills that had to create the best op-tion for reorganization of the enforcement agency, the quality of which depends on many factors, as: welfare, life, health, rights and freedoms of citizens and others. In the legislative process there is always an important issue to determine the principles which will establish the basic foundations of functioning entity whose activity is regulated by this legal act. Several principles stipulated in the law are traditional, as those reflected in every normative act regulating activities of any law enforcement agency. However, a number of principles bring novelty to the process of reform of the Ministry of Internal Affairs. The purpose of this article is to deter-mine the principles of policing that are not included in the Law of Ukraine «On the national police» underlying the functioning of the police. The article analyses the principles of the National Police, as well as attempts to define other basic policing foundations of the central executive body, including those that are not reflected in the Law of Ukraine «On the national police». These principles may be important for the future preparation of other regu-lations that will regulate the functioning of the police. Today the process of reform of the Ministry of Internal Affairs is an integral part of the democratization of public life and the rule of law. Changes in socio-economic, political and legal conditions for functioning of the Ministry of Internal Affairs, the country’s course towards European integration, and therefore strict conformity of the National Police with European standards determine a departure from the Soviet model and needs for transition to a new framework of practice, from punitive to social service functions. This is possible while respecting the principles of policing.
