Функції слідчого судді під час здійснення досудового розслідування

Abstract

Зауважено, що основою судово-правової реформи, яка здійснюється в Україні, є переформування специфіки діяльності суду. Водночас змінюється призначення і діяльність інших державних органів та інститутів. У зв’язку з цим законодавець по-новому окреслив роль органів досудового розслідування, прокурора, суду, особливо слідчого судді в кримінальному провадженні, зокрема їх повноваження і вплив на права і свободи учасників кримінального провадження. Висвітлено теоретичні та практичні проблеми визначення функціональної діяльності слідчого судді. Виділено три кримінально-процесуальні функції під час здійснення досудового розслідування слідчим суддею: забезпечення законності та обґрунтованості обмеження прав і свобод учасників кримінального провадження та інших осіб; судовий контроль; проведення слідчих дій з метою забезпечення доказів. Підкреслено, що слідчий суддя, крім здійснення судового контролю, має значно більше повноважень. Із діяльності слідчого судді контролем (із певними зауваженнями) можна назвати розгляд скарг на дії, бездіяльність, рішення слідчого, прокурора та перевірку підстав для проникнення до житла чи іншого володіння особи без ухвали слідчого судді, перевірку підстав для проведення негласної слідчої (розшукової) дії у виняткових невідкладних випадках. It is noted that the basis of judicial reform, which is held in Ukraine is re-forming the specifics of the court activity. However, the purpose and activities of other state bodies and institutions are being changed. In this regard, the legislator saw the new role of the pre-trial investigation, the prosecutor, the court, and especially the investigating judge in criminal proceedings, including their powers and influence on the rights and freedoms of participants in criminal proceedings. The article deals with theoretical and practical problems of determining the functional activity of the investigating judge. Three criminal proce- dural functions are distinguished during the preliminary investigation by the investigating judge: ensuring the legality and validity of restrictions on rights and freedoms of the participants of criminal proceedings and other persons; judicial review; the investigation to provide evidence.; judicial review; the function of the investigation to provide evidence. So, in general, it should accept the fact that the investigating judge doing judicial control has considerably more power. Indeed, with all activities of the investigating judge control (with certain remarks) can be called complaints against actions, inaction, decisions of investigator, prosecutor and verification of the grounds for entry into a dwelling or other property without approval to check the investigating judge for tacit investigative (detective) action in exceptional urgent cases. There is neither licensing authority nor ensure the legality and validity of the use of measures of criminal procedure compulsion, control features (in its general legal sense).
