О. Ейхельман про правові аспекти територіальної організації Української держави

Abstract

На основі вивчення теоретичної спадщини відомого українського вченого-правника кінця ХІХ – першої половини ХХ століття О. Ейхельмана проаналізовано його погляди на територіальну організацію України у формі симетричної федерації. Зазначено, що концептуальні ідеї О. Ейхельмана щодо федеративного державно-територіального устрою, правових аспектів регіональної політики, реформи місцевого самоврядування, територіальної цілісності України були ключовими у його наукових пошуках. On the basis of the theoretical heritage of the famous Ukrainian scientist, lawyer of the late XIX – early XX century О. Eyhelman analysis of his views on the territorial organization of the Ukraine in the form of symmetrical federation was done. For Ukraine, which is in the process of reforming its political system is an important problem of determining the form of state and territorial division, the division of powers between the center and the regions. Understanding relationships in the «center –regions» importance in view of the fact that the process of Ukrainian lands in the modern borders ended a little more than half a century ago. In Ukrainian regions significantly differ not only in economic and social structure, but the public mood, they traced unequal foreign policy, ethnic and ethno-cultural orientation. These differences create, especially in poor consolidation of Ukrainian society, a dangerous potential for disintegration and erosion of state sovereignty. Therefore, it is essential to study patterns and trends of regionalization of software searches the principles, ideas, norms of legal mechanisms and institutions that can mitigate the conflicts that arise between the central government and the regions. Future system state and territorial structure of Ukraine рrof. О. Eyhelman seen in the form of a union state in which the constituent power of the people, whose will is determined during the nationwide referendum. The central idea of his concept – a union of some lands that are combined into a single federal state without exit. The distribution of powers between the community, county, and state land, self-government communities, according to О. Eyhelman, was an alternative to administrative centralism. The territorial organization of the Ukrainian state, the scientists suggested, was to provide a balance of national, regional and local interests and guarantee the territorial integrity of the state borders. It is shown that the conceptual ideas О. Eyhelman on the federal stateterritorial structure, legal aspects of regional policy, local government reform and territorial integrity of Ukraine were key in his academic pursuits.
