Організація та планування досудового розслідування розбоїв, учинених неповнолітніми

Abstract

Проаналізовано поняття та ознаки категорії «організація розслідування кримінальних правопорушень», види організації розслідування, взаємозв’язок понять «організація» та «планування досудового розслідування». На підставі положень закону, підзаконних нормативно-правових актів і наукових позицій учених-криміналістів запропоновано елементи планування та типову форму плану розслідування розбоїв, учинених неповнолітніми. The article analyzes the concepts and features of such category as «Organization of investigation of criminal offenses», types of organization of pre-trial investigation, the relationship of the concepts of organization and planning of the pretrial investigation. It substantiates the provision that since planning is a program of the organization of the investigation, then the organization of the investigation in itself can be considered to be the practical implementation of this program. That is why planning is not just an element of organization of the investigation, but is an organizing basis (principle) of the investigation, i.e. only by means of planning it is possible to exercise in practice the organization of activities of crime investigation. At the same time the plan is not a dogma but the dynamic element of the structure which is changing (becomes simpler or complicated) depending on the situation, stages and objectives of the investigation, achieving of its goal. On the basis of law provisions, by-laws, regulations and scientific positions of scientists-criminologists following elements of planning of investigation of robberies committed by juveniles are offered: analysis of initial information as a precondition for the formation of the plan; bringing up the versions, description of measures of their tryout; forecasting, i.e. determining what new data can be received when checking the versions nominated; drafting the written plan to define the complex investigation (search), organizational and tactical measures, the most appropriate sequence of their execution and tactics of conduct, even their simultaneity if necessary, specification of powers and tools involved.
