Abstract

озглянуто актуальні проблеми правового регулювання нотаріальної діяльності в Україні. Розкрито зміст нотаріальної діяльності та поняття нотаріуса. Здійснено порівняльний аналіз доступу до професії нотаріуса за законодавством України упродовж 1994–2013 років. Розглянуто вимоги щодо осіб, які мають намір займатися нотаріальною діяльністю, за законодавством України, Республіки Молдова та Російської Федерації. Виявлено спільні риси та відмінності у правовому регулюванні допуску до складання кваліфікаційного іспиту осіб, які претендують на нотаріальну діяльність в Україні та Російській Федерації. Досліджено шляхи удосконалення законодавства, що регулює право на здійснення нотаріальної діяльності. Research devoted to the issue of legal regulation of notarial activities in Ukraine. During the years 2011–2012 the Law of Ukraine «On Notary» made numerous and significant changes that apply to the access to the profession of notary. The article describes the content of the notary business. Also the definition of a notary, as under the laws of Ukraine, and the law of the Russian Federation. Thus, a notary public in Ukraine can only be a citizen of Ukraine, who has a law degree, was a qualifying exam, received certificate of the notary's employment. There can be a notary person who has been convicted of a crime in a limited capacity or adjudicated incompetent by a court. The author made a comparative analysis of access to the profession of notary public under the laws of Ukraine for 1994–2013 years. Attention is paid to the notary institute significant adjustments, including strengthening the requirements for a person who wishes to become a notary. The article deals with the requirements for persons wishing to engage in notarial activities under the laws of Ukraine, Republic of Moldova and the Russian Federation. The author has found similarities and differences in the legal regulation of admission to a qualification examination of persons claiming to engage in notarial activities in Ukraine and the Russian Federation. Investigate ways to improve the legislation regulating the right to perform notarial activities . Proposed to be amended as the Law of Ukraine «On Notary» and the Procedure of admission of persons to a qualification examination and conducting qualifying examination by the High Qualifications Commission, approved by the Ministry of Justice of Ukraine July 28, 2011, № 1905/ 5 on the right of admission to a qualification examination persons who have experience in the field of law at least six years and are at least three years working with the Ministry of Justice of Ukraine, the Main Department of the Ministry of Justice of Ukraine in the Autonomous Republic of Crimea, the Department of Justice in the cities of Kyiv and Sevastopol in positions with direct control over the organization of the notary, notary verification of the activities of notaries and enforcing the rules of the notarial record keeping.
