Онтологічний аспект дослідження проблематики впливу феномена корупції на фундаментальні засади забезпечення конституційного правопорядку в Україні та світі

Abstract

Викладено узагальнення щодо філософсько-правової оцінки сутності корупції, її тенденцій, що є характерними для сучасного етапу процесів право-та державотворення. Розглянуто питання значення оптимізації публічно-правового апарату як методу запобігання та протидії корупції. За результатами компаративістського аналізу екстраговано комплекс факторів, що детермінують інтенсифікацію негативних проявів корупціалізації функціонування ланок публічного апарату та виокремлено праксеологічні методи нейтралізації їх активності. На основі узагальнень правової доктрини запропоновано інноваційний концепт інтерпретації феномена корупційної пастки та показника соціальної ціни корупції у контексті розбудови різних типів державності. In this article the generalization sonh istorical estimates of corruption, trends that represent modern state of legal sphere, addresses the social and economic consequences of corruption in society hasbeen analyzed and the basic direction of counteraction to this negativephe nomenon were under lined. As a result of comparative analysis a set of factors that determine the intensification of negative effects of corruption of the functioning parts of the public system and singles out the praxeological methods of their activity neutralization were been extracted. Corruption is stated to be something negative. This phenomenon should be in a level inversely proportional to the degree of efficiency of government. High level of corruption indicates the practical inability of the state to ensure the implementation of its policy vector and indicates the lack of control of social and economic processes. Corruption represents the domination of unofficial economy in the certain state. Summarizing these facts, it can be stated that corruption is a key factor of state destabilization in international political realm, a kind of precondition for economic separation and determining the cause of most diplomatic collapse, which in its unity lead to state’spermanent economic and political stagnation. In the article following segments of corruption effects were been underlined: 1) Domestic – degradation processes are endogenous to the specific political and territorial organization of public authority of the certain state with absent or minimalaffect on transnational political, economic and other social processes; 2) Transnational – orruption consequences that significantly influence the foreign policy of states, causing a negative transformation of attribute specifications. On the basis of generalizations of legal doctrine components innovative concept of interpretation of the phenomenon of «corruption trap», and indicator «social cost» of corruption in the context of the development of different types of state has been proposed.
