Забезпечення адміністративного позову у справах про оскарження рішень щодо застосування заходів впливу щодо застосування заходів впливу за порушення бюджетного законодавства

Abstract

Досліджено окремі проблеми застосування норм Кодексу адміністративного судочинства України про забезпечення адміністративного позову у справах щодо оскарження рішень стосовно застосування заходів впливу за порушення бюджетного законодавства. Розглянуто підстави та види забезпечення адміністративного позову. Проаналізовано розглянуті адміністративними судами справи про оскарження рішень про застосування заходів впливу за порушення бюджетного законодавства, які містять клопотання щодо забезпечення позову. Сформульовано пропозиції щодо формулювання змісту клопотань про забезпечення адміністративного позову у зазначеній категорії адміністративних справ. This paper investigates some problems of application of the Code of Administrative Procedure of Ukraine providing administrative action in cases of appeal against decisions of enforcement for violations of the budget legislation. We consider the reasons and types provide administrative claim. The analysis considered the case on the administrative courts of appeal decisions on enforcement for violations of the budget legislation that contains a motion on the claim. A provision of administrative action in cases of appeal against enforcement for violations of the budget legislation to consider taking administrative court dealing with the case, measures to suspend the decision (or part thereof) that applied the measure of influence, or (and) on the prohibition certain acts that guarantees real performance received positive judgment. In view of the analysis of judicial practice, it is proposed to distinguish these types of claim in this type of case: termination decision subject budgetary control, which applies one of the means, the prohibition of the defendant or other legal entity budget to make decisions about the use of new interventions for the same offense or re-use the same action, or to perform other actions, and suspension of the decision the subject of budgetary relations and ban him perform certain actions. Such request (if meet court) and stop operation of the contested decision in order to prevent unfavorable financial consequences for the plaintiff, and whether the recipient of a secure budget for the adoption of other decisions of the proceedings of enforcement for violations of the budget legislation.
