Особливості профілактичної діяльності органів внутрішніх справ у боротьбі з рейдерством в Україні

Abstract

Досліджено проблеми профілактичної діяльності органів внутрішніх справ України щодо дій, пов’язаних із незаконним поглинанням підприємств, що кваліфікуються як злочини та адміністративні правопорушення. Зосереджено увагу на цілях, принципах, функціях, методах і видах профілактичної діяльності міліції у сфері боротьби з незаконним захопленням власності внаслідок рейдерських атак. Ефективність профілактичних заходів органів внутрішніх справ щодо дій, які пов’язані з рейдерством, визначається динамікою злочинності у співвідношенні з якісними та кількісними показниками статистичних даних та експертних оцінок стану злочинності у зазначеній сфері. In this article the problems of prophylactic activity of organs of internal affairs of Ukraine are investigated in relation to actions, enterprises that is characterized as crimes and administrative crimes related to illegal absorption. A corporate raid is in Ukraine, being on maintenance and by a form by objective reality of modern home economy, that purchased scale character, creates, no doubt, a threat to her functioning. The basic sign of this negative phenomenon consists in the breach of law, application of those or other knavish charts in relation to the intercept of operative management an enterprise, by establishment or organization and realization of their assets on the discretion. A theory of fight against a corporate raid in the legal doctrine of Ukraine is on the initial stages of the development, at the same time is one of actual directions of scientifically-research activity in relation to the legitimate reaction of the state on violation of rights, freedoms or interests of person, property and corporate laws, attempt of their defence and renewal at mediation of legal methods. Specified, that a prophylaxis of the actions related to the corporate raid is the function of organs of internal affairs of all levels, their branch services, subdivisions and employees that carry out a general and individual prophylaxis within the limits of the competense, prevent misconducts, that prepare. Socioeconomic realities require transformation of prophylaxis of the actions related to the corporate raid, on the really guided process, that envisages thorough knowledge of his essence, forces, facilities, mechanism functioning that provide gaining end of prophylactic activity. Attention is concentrated on aims, principles, functions, methods and types of prophylactic activity of militia in the field of a fight against illegal fascination of property as a result of raider attacks. Efficiency of prophylactic measures of organs of internal affairs in relation to the actions related to the corporate raid is determined by the analysis of crime wave in relation to quality and quantitative indexes on the basis of statistical data and expert estimations in relation to the state of criminality in the field of marked.
