Психологія присяжного при прийнятті ним судового рішення

Abstract

Досліджено питання необхідності існування суду присяжних та забезпечення ефективності його функціонування у вітчизняному судочинстві. Проаналізовано позиції та аргументи і прихильників існування цього інституту, і його противників. Розглянуто психологічні особливості діяльності суду присяжних під час судового розгляду, чинники, що впливають на сприйняття ними обставин справи, а саме емоційну сторону, адже керуючись здебільшого емоціями, присяжні не завжди можуть правильно оцінити обставини справи, що, відповідно, вплине на прийняття рішення. Зʼясовано поняття внутрішнього переконання присяжного, порядку його формування, чинників, які впливають на таке переконання, зокрема важливість діяльності сторін кримінального провадження, а також вплив індивідуально-психологічних особливостей присяжних на винесення судового рішення. The article deals with the issues of the necessity of the existence of the jury and ensuring the effectiveness of its functioning in the domestic legal proceedings. The positions and arguments of both the supporters of the existence of this institution and its opponents are analyzed. The psychological peculiarities of the activity of the jury at a court trial, the criteria of internal convictions are studied. Considerable attention is paid to the factors that influence the perception of the circumstances of the case, namely, the emotional side, because, guided mainly by emotions, jurors may not always correctly assess the circumstances of the case, and it will accordingly affect the decision. The author pays attention to those mental processes, by means of which the jurors could make a decision more efficiently; in particular, the question is in the fact that the activity of jurors concerning the knowledge of the circumstances of criminal proceedings is primarily related to psychological tension, memory strain, high concentration, and attentiveness. That is, all cognitive, emotional and volitional mental processes that are closely interrelated must be actively involved. The concept of internal conviction of the juror, the order of its formation, factors influencing such beliefs are defined. In particular, the significance of the activity of the parties of criminal proceedings, which should take into account such methods of influence on jurors, as the use of simple and accessible legal terms in order to understand the meaning of words easier and the presentation of information gradually, is investigated. It is important to establish a psychological contact with jurors, sincerity and competence of the communicating person. The influence of individual psychological peculiarities of jurors on a court decision is also significant for the effective exercise of their powers, accordingly, the approach to their selection should be premeditated, and only specialists with psychological education should be involved in such a process.
