Abstract

Сім'я - найголовніша життєва цінність. Саме від відносин, які складаються в сім'ї, залежить реалізація особи в інших сферах життєдіяльності. «Сімейне право» є однією з важливих навчальних дисциплін. Метою його вивчення є формування та закріплення юридичного світогляду у здобувачів вищої освіти, підготовка фахівців, що володіють високим рівнем теоретичних знань в галузі сімейних правовідносин, необхідних для поглибленого засвоєння інших юридичних дисциплін та успішного застосування цих знань у подальшій практичній діяльності. Автори підручника врахували наукові досягнення у сфері сімейного права для формування у здобувачів вищої освіти систематизованих уявлень про основні інститути сімейного права. У підручнику викладено основні питання сімейного права: предмет і метод сімейного права, сімейні правовідносини, поняття сім’ї та шлюбу, припинення шлюбу і визнання його недійсним, особисті немайнові та майнові права та обов’язки подружжя, права та обов’язки матері, батька і дитини, форми влаштування дітей-сиріт та дітей, позбавлених батьківського піклування, права та обов’язки інших членів сім’ї та родичів, застосування сімейного законодавства до відносин за участі іноземних осіб та осіб без громадянства. У підручнику розглядаються найважливіші теоретичні питання правового регулювання сімейних відносин з урахуванням усіх змін і доповнень, внесених до сімейного законодавства останнім часом. Пiдготовлений колективом викладачiв кафедри цивiльного права та процесу та цивільно-правових дисциплін Львівського державного університету внутрішніх справ на основi Сiмейного кодексу України i вiдповiдно до нової програми навчальної дисципліни «Сiмейне право». Підручник розрахований для здобувачів вищої освіти усіх форм навчання, аспiрантiв i викладачiв вищих навчальних юридичних закладiв освiти, а також наукових i практичних працiвникiв. Family is the most important vital value. It is from relationships which are formed in the family, the realization of the person in other spheres of life depends. "Family Law" is one of the important educational disciplines. The purpose of its study is to form and consolidate the legal world outlook for higher education graduates, to train specialists with a high level of theoretical knowledge in the field of family legal relations necessary for in-depth mastery of other legal disciplines and the successful application of this knowledge in further practical activities. Authors of the textbook took into account scientific achievements in the field of family law in order to form systematized representations about the basic institutions of family law in higher education applicants. The textbook describes the main issues of family law: the subject and method of family law, family relationship, the concept of family and marriage, the termination of marriage and the recognition of it invalid, personal non-property and property rights and duties of the spouses, rights and responsibilities of the mother, father and the child, the forms of placement of orphans and children deprived of parental care, the rights and obligations of other family members and relatives, the application of family law to relations with the participation of foreigners and stateless persons. The textbook examines the most important theoretical issues of legal regulation of family relations, taking into account all the changes and additions introduced to family law in recent times. Prepared by a team of teachers of the Department of Civil Law and the Process and Civil Law Disciplines of Lviv State University of Internal Affairs on the basis of the Family Code of Ukraine and in accordance with the new programme of the educational discipline "Family Law". The textbook is designed for applicants of higher education of all forms of education, aspirants and teachers of higher educational legal institutions, as well as scientific and practical workers.
