Імплементація міжнародних стандартів прав людини в національному законодавстві

Abstract

Досліджено проблему імплементації міжнародних стандартів прав людини, що містяться в міжнародних договорах, у національному праві України. Визначено основні принципи, правила та підходи до тлумачення міжнародних договорів про права людини. Наголошено, що тлумачення норм права – це різновид юридичної діяльності і йому притаманні ознаки, які відрізняють цю діяльність від інших видів. Встановлено, що тлумачення положень міжнародного договору – це тлумачення юридичної норми, тому до нього застосовуються всі принципи і прийоми, які відомі в теорії права. Зазначено, головні правила тлумачення міжнародних договорів про права людини визначаються у Віденській конвенції про право міжнародних договорів 1969 р. Запропоновано систему принципів, які використовуються у міжнародно-правовій практиці тлумачення договорів. Обґрунтовано, що в разі тлумачення положень міжнародних договорів про права людини слід брати до уваги позицію міжнародних судових, квазісудових чи моніторингових органів, юрисдикція яких поширюється на питання тлумачення та застосування відповідних міжнародних договорів. Compliance of standards of the international human rights issue is payed attention in Ukraine, especially in connection with the reforms take place in the system of authоrities. Implementation of standards and their effective realization in the country, in particular, under of national legislation, causesthe urgency of interpretation of the international human rights treaties which are the basis of these standards. The article analyses international standardsʼ implementation of human rights that are included in Ukrainian international treaties. The independent attention is paid to defining basic principles, rules and approaches to interpretation of international treaties of human rights. The paper emphasizes that interpretation of legal norms is the form of legal activity and correspondent features that distinguish this activities from others. Itʼs pointed out that interpretation of international treaty is the interpretation of legal norms, thatʼs why all principles and methods known in theory of law are applied towards it. Itʼs defined that basic rules of international treatiesʼ interpretation of human rights are defined in Viennese convention of international treaties right of 1969. The system of principles that are applied in international legal practice of interpretation of treaties is suggested in the paper. Itʼs found out that in the process of interpretation of international treaties principle of human rights the attention should be paid to the position of international judicial, quasi-judicial or monitoring bodies, which jurisdiction is spread on issues of interpretation and applying of corresponding international treaties.
