Міжнародні стандарти накопичення та використання біометричних даних (зразків ДНК) у діяльності правоохоронних органів

Abstract

Стаття присвячена міжнародним стандартам накопичення та використання біометричних даних (зразків ДНК) у діяльності правоохоронних органів. У законодавстві України не визначено чітких законодавчих рамок формування та використання біометричних даних, внаслідок чого правоохоронні органи наділені необмеженими дискреційними повноваженнями щодо формування баз даних з профілями ДНК. На підставі аналізу наукових праць, практики Європейського суду з прав людини та законодавчого досвіду окремих зарубіжних держав запропоновано вдосконалити норми КПК України щодо накопичення та використання біометричних даних (зразків ДНК) правоохоронними органами. The article is devoted to international standards for the accumulation and use of biometric data (DNA samples) in the work of police. The legislation of Ukraine does not defne clear legal frameworks for the formation and use of biometric data, resulting in law enforcement bodies having unlimited discretionary powers to form databases with DNA profles. In particular, the term for which DNA data can be stored is not specifed, the legal status of the persons from which such data (the suspect, the accused), the gravity of the crimes in which they are suspected cannot be detailed, which gives grounds for collecting such data, the absence of a special base data for DNA profles obtained as a result of obtaining biological samples that facilitate identifcation and search for criminals. An analysis of the practice of the ECHR has shown that the Court fnds that the interference with the right to respect for private life is justifed by the selection of individuals in biological samples in order to protect against the most dangerous threats to national security, for the prevention of terrorism, the disclosure of violent crimes, etc. In particular, the ECHR analyzes the proper quality of the national legislation regulating the issue of limiting the right to respect for private life by collecting and using biometric data in automated information resources. However, even if national legislation meets all the criteria for justifable interference with privacy on the part of law enforcement authorities, the need for such an intervention in a democratic society is sought in order to achieve the legitimate aim and proportionality of such a restriction between public or public interests and the protection of the privacy of individuals. On the basis of the analysis of scientifc works, the European Court of Human Rights practice and legislative experience of certain foreign states, it is proposed to improve the norms of the Criminal Procedure Code of Ukraine regarding the accumulation and use of biometric data (DNA samples) by police.
