Правові і організаційні засади регулювання контролю у сфері інформатизації

Abstract

У статті розглядаються правові і організаційні засади регулювання контролю у сфері інформатизації в контексті розвитку інформаційного суспільства в Україні на підставі безперервного удосконалення інформаційно-комунікаційних технологій. На підставі положень адміністративного і інформаційного права, з урахуванням адаптації національного законодавства до вимог Європейського Союзу, аналізується поняття контролю у сфері інформатизації, визначаються його складові. This paper deals with the legal and organizational principles regulation of control in the field of informatization in the context of the development of the information society in Ukraine. The concept of control in the field of informatization is analyzed, its components are determined. In this paper, we discuss the control allows of obtaining information on the state of the law in the field of informatization, on the content and direction of activity in a certain sphere, which contributes to the implementation of regulatory legal acts that regulate social relations. The main purpose of this paper is to the analysis of legal and organizational principles of regulatory control in the field of informatization. Special attention is given to the system of control in the field of informatization is manifests in a complex systems of checks and balances in the implementation of the principle of separation of powers, in the openness and accessibility of state bodies, in their accountability to the people, in interaction with the media and civil society institutions. The results of control can be considered as a process of gathering information about the deviation of the controlled object from the existing norm with the ability to influence it in order to eliminate the identified deviations and restrictions, in order to avoid negative consequences are determined. Conclusion regarding the foregoing, control can be viewed as a process of providing information about the disconnection of a controlled object from existing norms with possible interference with the local level of detection of deviations and restrictions in order to eliminate the occurrence of negative consequences arrived at.
