Загальна характеристика заходів процесуального примусу, які застосовуються в адміністративному судочинстві України

Abstract

Стаття присвячена особливостям реалізації заходів процесуального примусу, передбачених Кодексом адміністративного судочинства. Заходи процесуального примусу - це процесуальні дії, що здійснюються судом у випадках, визначених процесуальним законом, щоб заохотити відповідних осіб дотримуватися встановлених судом правил, сумлінного виконання процесуальних обов'язків, заборони зловживання правами та запобігання незаконним протиправним діям під час під час здійснення судочинства . Заходи процесуального примусу поширюються лише на осіб, які порушили порядок, встановлений в суді під час адміністративної справи (порушення порядку може виражатися в недоречних образах, неповазі до суду, недотриманні вимог головуючого, поданні документів через судового розпорядника тощо), а також осіб, які перешкоджають здійсненню адміністративних процедур під час адміністративного судочинства. The article is devoted to the peculiarities of the implementation of measures of procedural compulsion provided by the Code of Administrative Proceedings. Measures of procedural compulsion are procedural actions taken by the court in cases specified by procedural law to encourage the persons concerned to comply with the rules established by the court, conscientious performance of procedural duties, prohibition of abuse of rights and prevention of illegal acts during the proceedings. Compulsive measures apply only to persons who violated the order established in the court during an administrative case (violation of the order may be expressed in inappropriate insults, contempt of court, failure to comply with the requirements of the presiding judge, submission of documents through a court administrator, etc.), as well as persons who obstruct implementation of administrative procedures during administrative proceedings. Measures of procedural coercion are procedural actions taken by the court in order to induce the relevant persons to comply with the rules established by the court, conscientious performance of procedural duties, termination of abuse of rights and prevention of illegal obstacles to the administration of justice. The application of measures of procedural compulsion is possible by courts of all parts of the judicial system, but is excluded during the court hearing. Measures of procedural compulsion should be distinguished from measures to ensure proceedings in cases of administrative offenses. Signs of measures of procedural compulsion are the following: formality, authoritarian nature, non-property character influence, compulsive character, simplicity, efficiency, economy, procedural mode of application, legal nature. Measures of procedural compulsion should be distinguished from measures to ensure proceedings in cases of administrative offenses measures of procedural compulsion provided for in the Criminal Procedure Code of Ukraine.
