Abstract

На основі комплексного дослідження теоретико-правових аспектів співвідношення та взаємодії права та моралі з'ясовано сутнісні підстави впливу цих категорій на формування соціальних уявлень про шляхи трансформації сучасного суспільства, обгрунтовано наукознавчу парадигму загальнотеоретичного правознавства щодо актуалізації вивчення категорій права і моралі, що дало змогу визначити роль цих суспільних чинників у формування соціуму та регуляції поведінки особистості. The dissertation deals with the comprehensive scientific research of theoretical and legal aspects of relationship and interaction between law and morality, and on this ground the essential reasons of these categories influence on the formation of social representations about the ways of transformations of modern society are found out; a scientific paradigm of general and theoretical jurisprudence as to making actual the process of studying of categories of law and morality is grounded, that gives a possibility to define the place of these social factors in shaping a society and the regulation of individual behavior. From a standpoint of the theory of law and state special emphasis is made on interpretation of understanding and perception of morality and law as public and social phenomena, the institutionalization of their regulation in terms of building a democratic, legal state with a developed civil society. In this regard, it is stressed the importance of moral and legal impact on improving the law-making processes and implementation of law, on the legal framework creation, which must meet the present requirements. The theoretical and conceptual bases of the necessity to reform the law enforcement system are grounded, one of the ways of which should be the implementation of effective measures to improve the efficiency of interaction of law and morality norms in the formation of consciousness, in the implementation of the qualification of a new type of workers of the reformed law enforcement agencies in our country.
