Features of detection and obtaining evidence of war crimes committed in the context of international armed conflict (Scopus, Web of Science)

Abstract

Наукова стаття присвячена всебічному осмисленню міжнародно-правових, процесуальних та організаційних проблем розслідування військових злочинів, вчинених під час військового конфлікту на півдні та сході України. Розвинуто авторську концепцію розслідування військових злочинів, вчинених під час збройного конфлікту, науково обґрунтовані теоретичні положення та конкретні закономірності, які проявляються у сфері правового забезпечення, організації розслідування, збирання доказів, методики розслідування злочинів цього виду. Зроблено висновок про те, що існує необхідність вказати ознаки військових злочинів в національному законодавстві. Рекомендації щодо подальшого вдосконалення кримінального та кримінального процесуального законодавства України з метою виконання взятих на себе міжнародних зобов'язань держави в галузі прав людини. The scientifc article is devoted to a comprehensive understanding of international legal, procedural, and organizational problems of investigation of war crimes committed during the military conflict in the south and east of Ukraine. It develops the author’s concept of investigation of war crimes committed during the armed conflict, scientifcally substantiated theoretical provisions and specifc patterns that are manifested in the feld of legal support, organization of investigation, collection of evidence, methods of investigation of crimes of this type. It is concluded that there is a need to specify the components of war crimes in national legislation. Recommendations for further improvement of criminal and criminal procedure legislation of Ukraine in order to fulfll the state’s international obligations in the feld of international humanitarian law are given.
