Становлення моделі «сервісної» поліції в Україні: історико-правове дослідження

Abstract

У статті досліджено становлення моделі сервісної поліції, її історичні передумови та еволюцію розвитку в Україні. Зазначено, що в більшості демократичних держав світу інститут поліції розвивається на основі сервісної моделі. І саме вивчення міжнародної практики, національного законодавства, звітів міжнародних організацій, які тривалий час досліджують питання розвитку й утримання безпеки, підвищення ефективності роботи поліції, засвідчило наявність більш ніж 40-річного досвіду країн у розвитку моделі «сервісної» поліції. Наголошено, що виконання соціально-сервісної функції органів державної влади – охорона публічного порядку – і передбачає співпрацю поліції з різними державними й недержавними інституціями, зокрема органами місцевого самоврядування та громадськими об’єднаннями. Зроблено висновок, що запропонована для впровадження в Україні модель «сервісної» поліції вимагає переоцінки функцій щодо запобігання злочинності й насильству, але в жодному разі не відводить чи ігнорує функції реагування та розслідування злочинів, яких дотримується вся поліція. Поліція в рамках «сервісної» моделі зберігає свої традиційні функції як правоохоронний орган, вона має зобов’язання реагувати на відповідні виклики громадян, приймає всі вичерпні заходи щодо боротьби зі злочинністю та захисту життя і здоров’я громадян. The article examines the formation of the service police model, its historical background and the evolution of development in Ukraine. It is noted that in most democracies of the world the institution of police is developing on the basis of the service model. And the study of international practice, national legislation, reports of international organizations that have long examined the development and maintenance of security, improving police efficiency, showed more than 40 years of experience of some countries in developing the service police model. It is emphasized that carrying out the social service function by public authorities – the protection of public order – involves the cooperation of the police with various governmental and non-governmental institutions, including local selfgovernment bodies and NGOs. The problems related to the interaction between the police and civil society in Ukraine do not differ significantly from the problems related to the development of police systems in other countries. Loss of confidence, excessive militarization, lack of efficacy of police services, poor training, corruption, image problems, outdated equipment, outdated management practices and decision-making systems, inflated expectations of society, etc. are the main obstacles to carrying out the service function by the modern police. In order to implement the first elements of the service police model based on foreign experience, civil society proposals and the OSCE recommendations, a project began to be implemented in Ukraine in 2020, which provides for close cooperation between government bodies and society to effectively combat crime and increase public confidence in government bodies to improve the quality of life of people. The prospects of this model are quite convincing, and international practice shows that the application and full adaptation of the service police model will be the foundation for building public trust in the police. It is concluded that the proposed service police model in Ukraine requires a reassessment of the functions of crime and violence prevention, but in no way diverts or ignores the functions of the entire police of responding to and investigating crimes. Within the framework of the service model, the police retains its traditional functions as a law enforcement agency – it is obliged to respond to the relevant calls from individuals, takes all comprehensive measures to combat crime and protect the lives and health of individuals.
