Проблеми клонування людини: правовий та моральний аспекти

Abstract

Стаття присвячена дослідженню проблем клонування людини, зокрема проблемам етичного, світоглядного, філософського та правового характеру. Підкреслюється, що людина вторгається у сферу буття, за яку не несе відповідальності з огляду на свою природу, тож наслідки таких кроків непередбачувані. Технологія клонування людини як вид штучного розмноження може призвести до зміни суспільної свідомості, виникнення низки соціальних проблем і протиріч. Взаємовідносини між людьми і клонами, правовий статус останніх, права й обов’язки клонованого щодо своїх клонів і навпаки може стати предметом окремих розвідок у науці. Утім, ідеї клонування людини породжують дуже багато проблем, побороти які має наука. Водночас клонування можуть використовувати в лікуванні безпліддя, адже, на жаль, сучасні методи не дуже ефективні. Вагомими були б переваги використання клонування в хірургії: замість того, щоб використовувати матеріали чужих тіл, можна виростити клітини кісток, тканин, що ідентичні цим органам у людини, котра потребує лікування. Відтак грудні імплантати, зубні протези тощо стануть просто непотрібні, оскільки матеріали людської технології клонування не відрізнятимуться від природних людських тканин.The article is the study of the problems of human cloning, in particular the problems of ethical, ideological, philosophical and legal nature. It is emphasized that an individual invades the sphere of existence, for which he is not responsible due to his nature, so the consequences of such steps are unpredictable. An individual should never literally become the product of production. The technology of human cloning as a type of artificial reproduction can lead to changes in public consciousness and a number of social problems and contradictions. The relationship between humans and clones, the legal status of the latter, the rights and responsibilities of the cloned in relation to their clones, and vice versa may be the subject of some scientific research. However, the idea of human cloning raises many problems that science has to overcome. One of the main reasons why human cloning is unacceptable is that it can allow people to clone themselves. That is, people will be tempted to get their twin or clone, for example, a deceased child. One might think that in this way one can get a new Einstein or lead a league of super-humans or super-athletes or, on the contrary, breed villains who lived before. And this list can go on. On the other hand, cloning can be used for the treatment of infertility, because, unfortunately, modern methods are not very effective. And the advent of human cloning technology will make it more realistic for infertile couples to have a baby than ever before. The benefits of using cloning in surgery would be significant: instead of using somebody else’s body materials, one can grow bone and tissue cells that are identical to these organs in a person undergoing treatment. As a result, breast implants, dentures, etc. will simply become unnecessary, because the materials of human cloning technology will not differ from natural human tissues. The problem of human cloning is first of all an ethical, world-view, philosophical problem and it is obvious that it also has its legal issues. On the other hand, the problem of cloning is a problem of human freedom, equality and equal rights. In particular, it is related to the fact that people have the same (equal) social opportunities to meet their needs, realize their interests, achieve their goals.
