Abstract

Розкрито зміст та обсяг поняття системного тлумачення кримінального закону. Охарактеризовано співвідношення системного тлумачення криміналь-ного закону із суміжними поняттями, сформульовано й обґрунтовано правила та прийоми системного тлумачення кримінального закону, а також можливість їх реалізації на практиці. Для студентів юридичних факультетів вищих навчальних закладів, науковців, працівників правоохоронних та судових органів.The system and system-forming relations of the criminal law are analyzed. The concept of the system interpretation of the criminal law is formulated on the basis of the system analysis of the scientific resources; its significant and insignificant features are analyzed. The correlation of the system interpretation of the criminal law with other ways of interpretation is investigated. The possible methods and rules of the system interpretation of the criminal law are grounded, the peculiarities of the application of such rules are characterized. At is also said that at the modern stage of the development of the legislation system it is necessary to use the system interpretation of the criminal law combined with other methods.
