Аналіз статей особливої частини Кримінального кодексу України, в яких заподіяння смерті особі через необережність є ознакою основного складу злочину, а також проблеми їх диференціації

Abstract

Розглянуто питання кримінально-правової кваліфікації та визначено зміст статей Особливої частини Кримінального кодексу України, в яких заподіяння смерті особі через необережність є ознакою основного складу злочину. Зʼясовано в них основний безпосередній обʼєкт та, у разі наявності обовʼязкового додаткового обʼєкта злочину, окреслено роль субʼєкта, обʼєктивної та субʼєктивної сторони, а також питання проблем їх диференціації. Досліджено склади злочинів, у яких заподіяння смерті особі через необережність є ознакою основного складу злочину. Проаналізовано праці науковців, що займалися цією тематикою. Наведено власне бачення щодо вдосконалення закону про кримінальну відповідальність, зокрема деяких злочинів, де наслідком є заподіяння смерті особі через необережність. The paper deals with investigating the issues of criminal-law qualification and determining the content of articles of the Special Part of the Criminal Code of Ukraine, in which causing the death of a person by negligence is an element essential to the crime; determining their major direct object, and, if there is a compulsory additional object of the crime, defining the role of the subject, the objective and subjective side, the issues of their differentiation, illogical normative structuring of the Special Part of the Criminal Code and attribution of human life in the body of the crime not to the principal, but to the supplementary object, which generates certain negative legal consequences, including the bringing of perpetrators to criminal liability and the imposition of just punishment. In particular, the issues of differentiation of articles and statement of various sanctions in them allow law enforcement agencies in the course of practical activities to vary the articles of the Special Part, in which the consequence is the negligent death of a person, and to make mistakes in the criminal-law qualification of the act. Despite the generally accepted value of human life, law-making and lawenforcement practice of Ukrainian criminal law does not always meet the require ments of guaranteeing and protecting the right to life, creating conditions for its free implementation. Therefore, the issues of improving the legal mechanisms for implementing the right to life, defining the legal principles of protecting human life from illegal, unlawful encroachments are of great importance. The author investigates the body of crimes in which causing the death by negligence is an element essential to the crime, analyzes the works of scientists engaged in the subject, makes suggestions for improving the law on criminal liability, namely for certain crimes, in which the consequence is causing the death by negligence.
