Охоронна функція української держави в умовах європейської інтеграції

Abstract

У статті на підставі чинного законодавства розглянуто охоронну функцію Української держави в умовах воєнної експансії російської федерації, входження України в єдиний європейський економічний і політичний простір. Предметом дослідження є правові норми, що визначають охоронну функцію держави, чинне законодавство України та практику застосування; теоретичні проблеми охоронної функції держави. У роботі застосовувався діалектичний метод, що дозволив досліджувати охоронну функцію комплексно, у розвитку та у зв’язку з іншими явищами соціальної дійсності та структурно-правовий, порівняльно-правовий та формально-юридичний методи. Зазначено, що охоронна функція держави – це обумовлений її соціальним призначенням правовий вплив, спрямований на охорону найважливіших економічних, політичних, культурних, духовних, особистих та інших відносин. Охоронна функція забезпечує дію всіх загальносоціальних функцій держави. Ознаками функцій держави є: предметна діяльність держави в різних сферах життя; безпосередній зв’язок між сутністю держави та її соціальним призначенням, яка реалізується у вигляді відповідних функцій; спрямованість функцій держави на виконання конкретних завдань та досягнення тих або інших цілей; реалізація функцій здійснюється у певних формах та особливими методами, властивими державній владі. Аналізується значення охоронної функції держави у контексті захисту природного середовища, національної культури, що безпосередньо зв’язано з суверенітетом та захистом національних інтересів у контексті російської воєнної експансії в умовах окупації частини Донецької та Луганської області та Криму. Критикуються погляди на проблему обмеження суверенітету в умовах європейської інтеграції щодо охоронної функції держави представників російського наукового середовища. Також зроблено висновок, що росія є державою-терористом і державою спонсором тероризму, а її політичний режим – неонацистський за своєю суттю і практикою; Україна – демократична держава, яка діє в інтересах Українського народу, приєднається до Європейського Союзу у дуже короткій перспективі. The article examines the protective function of the Ukrainian state in the conditions of the military expansion of the russian federation, Ukraine’s entry into the single European economic and political space on the basis of current legislation. The subject of the research is the legal norms that determine the protective function of the state, the current legislation of Ukraine and the practice of application; theoretical problems of the protective function of the state. The dialectical method was used in the work, which made it possible to investigate the protective function comprehensively, in development and in connection with other phenomena of social reality, and structural-legal, comparative-legal and formal-legal methods. It is noted that the protective function of the state is a legal influence determined by its social purpose, aimed at protecting the most important economic, political, cultural, spiritual, personal and other relations. The protective function ensures the operation of all general social functions of the state. Signs of the state’s functions are: substantive activity of the state in various spheres of life; direct connection between the essence of the state and its social purpose, which is implemented in the form of relevant functions; orientation of the functions of the state to the performance of specific tasks and the achievement of certain goals; implementation of functions is carried out in certain forms and special methods characteristic of state power. The significance of the protective function of the state in the context of the protection of the natural environment, national culture, which is directly related to sovereignty and the protection of national interests in the context of Russian military expansion in the conditions of the occupation of parts of Donetsk and Luhansk regions and Crimea, is analyzed. Views on the problem of limiting sovereignty in the conditions of European integration regarding the protective function of the state of representatives of the russian scientific environment are criticized. It was also concluded that russia is a terrorist state and a state sponsor of terrorism, and its political regime is neo-Nazi in essence and practice; Ukraine is a democratic state, that acts in the interests of the Ukrainian people and will join the European Union in the very short term.
