Деякі аспекти синонімії в англійській термінології кримінального права

Abstract

Термінологія кримінального права з’явилася внаслідок об’єктивної необхідності регулювання суспільних відносин. Юридичний термін – це загальноприйняте, упорядковане, належно оформлене слово чи словосполучення, яке точно позначає певне правове поняття. Юридичні терміни повинні точно відповідати певним явищам і бути зрозумілими не лише професіоналам-юристам, а й будь-якій пересічній людині. Проте і в юридичній термінології існують такі явища, як полісемія, омонімія й синонімія, які відображають пізнавальну та категоризуючу особливості розумової й мовної діяльності людини. Аналіз термінології кримінального права в англійській мові може бути корисним та актуальним для синтезуючого, комплексного вивчення синонімії, когнітивного й діяльнісно орієнтованого розуміння синонімічних процесів на лексичному та словотворчому рівнях, класифікації термінологічних синонімів, тенденцій розвитку цього мовного явища тощо. За своєю структурою англійські терміни-синоніми кримінального права поділяються на прості, складні, різнокореневі, словосполучення, синтаксичні, скорочення, акроніми. Синоніми також бувають абсолютними й відносними. На вживання термінів-синонімів впливають особливості правової системи в різних країнах. The terminology of criminal law appeared as a result of the objective necessity of regulating public relations. The correctness, clearness and accuracy are particularly decisive and critical in criminal law. A legal term is a generally accepted, regulated word or word-combination that is properly overtly marked and exactly denotes a certain legal concept. The legal term must exactly correspond to the definite phenomena and be understandable not only to professional lawyers, but to any person. But there are such phenomena as polysemy, homonymia and synonymy in the legal terminology that reflect the cognitive and categorical peculiarities of the mental and language activity of a person. The analysis of the terminology of criminal law in the English language can be useful and urgent for synthesizing and complex investigation of synonymy, cognitive and active oriented understanding of the synonymic processes on the lexical and word-building levels, developing synonymic links, roles of the synonyms in different terminological systems, classification of the terminological synonyms, tendencies of developing this language phenomenon, etc. As to its structure the English terms-synonyms of criminal law are divided into simple, complex, with different roots, word-combinations, syntactical, abbreviations, and acronyms. The synonyms can also be absolute and relative. The peculiarities of the legal systems in different countries influence the usage of the terms-synonyms, because thought they may belong to the same legal «family» they developed differently.
