Принципи здійснення валютного контролю в Україні

Abstract

Стаття присвячена дослідженню комплексного системного аналізу сучасного стану валютного контролю в Україні. Розглянуто чинне національне фінансове, валютне законодавство, підзаконні нормативно-правові акти та міжнародний досвід формування валютної системи. Зазначено, що досвід останніх років показав, що в Україні спостерігається недостатність державних ресурсів для фінансування основних завдань держави, а через порушення фінансової дисципліни виявлено значні втрати фінансових ресурсів. Недооцінка ролі фінансового контролю в Україні призвела до зловживань та порушень у сфері фінансових відносин. Тому саме складні економічні процеси й наслідки світової фінансової кризи показали необхідність удосконалення фінансово-валютної політики, а також радикальну зміну парадигми організації системи валютного контролю в Україні. Наголошено, що валютна політика – складова частина загальноекономічної, а саме, грошово-кредитної політики держави, спрямована на зміцнення валютно-фінансового становища країни, підтримку на високому рівні її платоспроможності та кредитоспроможності, забезпечення надходження валюти з-за кордону по зовнішньоекономічному обороту, протидія втечі капіталу за кордон, залучення іноземного капіталу. Важливість валютного валютного контролю для економіки очевидна. В умовах широкомасштабної втечі капіталу за кордон, відсутності достатніх іноземних інвестицій у національну економіку, військовий стан – ефективне валютне регулювання здатне змінити всі ці негативні тенденції на краще. Діяльність будь-якого органу державної влади та місцевого самоврядування та держави базується на принципах законності, гласності, плановості, які закріплено в Конституції України. Враховуючи те, що фінансова діяльність є одним із видів діяльності держави, а валютний контроль – невід’ємною частиною такої діяльності, то можна стверджувати, що ці принципи властиві і фінансовій діяльності, і валютному контролю. Реалізація принципів валютного контролю є необхідною умовою забезпечення правопорядку й законності в процесі здійснення фінансової діяльності. The article is devoted to the study of a complex system analysis of the current state of currency control in Ukraine. The current national fnancial and currency legislation, secondary legal acts and international experience in the formation of the currency system are considered. It is noted that the experience of recent years has shown that in Ukraine there is an insufciency of state resources for fnancing the main tasks of the state, and signifcant losses of fnancial resources have been revealed due to violations of fnancial discipline. Underestimation of the role of fnancial control in Ukraine led to abuses and violations in the feld of fnancial relations. Therefore, it was the complex economic processes and consequences of the global fnancial crisis that showed the need to improve the fnancial and currency policy, as well as a radical change in the paradigm of the organization of the currency control system in Ukraine. It was emphasized that the currency policy is a component of the general economic, namely, the monetary and credit policy of the state, aimed at strengthening the currency and fnancial position of the country, maintaining its solvency and creditworthiness at a high level, ensuring the inflow of currency from abroad through foreign economic turnover, countering flight capital abroad, attraction of foreign capital. In conditions of large-scale capital flight abroad, lack of sufcient foreign investments in the national economy, martial law – effective currency regulation can change all these negative trends for the better. The activity of any body of state power and local self-government and the state is based on the principles of legality, which are enshrined in the Constitution of Ukraine. Given that fnancial activity is one of the types of state activity, and currency control is an integral part of such activity, it can be argued that these principles are inherent in both fnancial activity and currency control. The implementation of the principles of currency control is a necessary condition for ensuring law and order and legality in the process of carrying out fnancial activities.
