Філософсько-правова аксіоматика розвитку громади

Abstract

У статті представлено результати дослідження проблеми дефініції громади у філософсько-правовому дискурсі. Обґрунтовано концептуальні положення щодо наукового осмислення громади, розкрито сутність та особливості її життєдіяльності, а також підходи до дослідження її розвитку. У результаті аналізу цілої низки наукових досліджень нами визначено концептуальні підходи щодо дефініції «громада», а саме: як історично утворена спільнота людей; як спільний, колективний споживач; як сукупність суспільних взаємодій; як суб’єкт місцевого самоврядування; як територіально-об’єднана сукупність людей; як базова адміністративно-територіальна одиниця; як сукупність інститутів; як суб’єкт цивільно-правових відносин, суб’єкт господарювання. Відзначено, що територіальну громаду слід розуміти як місцеве громадянське суспільство, яке є однією із передумов становлення успішних територіальних громад та активної участі громадян в їх розвитку. Очевидним є те, що нині демократичні інститути найефективніше функціонують в середовищі, в якому максимально дотримуються принципи громадянського суспільства. The article presents the results of a study of the problem of community definition in philosophical and legal discourse. Conceptual provisions on the scientific understanding of the community are substantiated, the essence and features of its life activity, as well as approaches to the study of its development are revealed. As a result of the analysis of a number of scientific researches we have defined conceptual approaches to the definition of «community», namely: as a historically formed community of people; as a common, collective consumer; as a set of social interactions; as a subject of local self-government; as a territorially united group of people; as a basic administrativeterritorial unit; as a set of institutions; as a subject of civil law relations, a business entity. It is noted that the territorial community should be understood as a local civil society, which is one of the prerequisites for the formation of successful territorial communities and active participation of citizens in their development. It is obvious that today democratic institutions function most effectively in an environment in which the principles of civil society are adhered to as much as possible.
