Теоретичні засади політики України у сфері протидії злочинності: автореферат

Abstract

Дисертація є комплексним науковим дослідженням теоретичних засад політики України у сфері протидії злочинності. У роботі визначено поняття ПСПЗ, проаналізовано ознаки, що їй притаманні, досліджено історію її становлення і розвитку. Особливу увагу приділено структурі ПСПЗ, зокрема її елементам та рівням. Досліджено суб’єкти та учасники ПСПЗ, принципи, а також джерела, мету та завдання. Розкрито зміст цих понять. Вивчено міжнародний досвід нормативного забезпечення політики у сфері протидії злочинності. Проаналізовано наукове та нормативне забезпечення ПСПЗ в Україні. Відтак встановлено, що питанню вдосконалення законодавства у сфері протидії злочинності, зокрема кримінального, постійно приділяється увага українських учених, які мають належний потенціал для наукового забезпечення ПСПЗ. У роботі висвітлено позицію, що визначення засад державної політики у сфері протидії злочинності у різного виду концепціях, програмах тощо, з огляду на їх декларативний характер, є неприйнятним. Такі акти, як засвідчує міжнародна практика, мають позитивний результат на місцевому рівні. Натомість на загальнодержавному рівні необхідним є прийняття відповідного закону. Розроблено пропозиції щодо удосконалення законодавства України у сфері протидії злочинності.This dissertation is the complex scientific research regarding of theoretical basis of policy of Ukraine in the sphere of counteraction crimes. The dissertation defines the notion of a policy in the sphere of counteraction crimes, analysis the signs that her peculiar, investigated the history of its formation and development. The special attention is spared to the structure of policy in the sphere of counteraction crimes, in particular to her elements and levels. Investigated subjects and participants, principles, and also sources, purpose, and tasks. Maintenance of these notions is exposed. International experience of the normative providing of policy in the sphere of counteraction crimes is studied. The scientific and normative providing of policy in the sphere of counteraction crimes in Ukraine is analysed. It is consequently set that a question of improvement of legislation is in the field of counteraction crimes, and first of all, criminal legislation, is in the sphere of permanent attention of the Ukrainian scientists that have the proper scientific potential for the scientific providing of policy in the sphere of counteraction crimes. The dissertation clarifies the position regarding the definition of the principles of the state policy in the sphere of counteraction crimes in various types of concepts, programs, etc. Such acts as international practice shows have a positive result at the local level. Instead, at the national level is necessary the adoption of the proper law. The worked out suggestions are in relation to the improvement of legislation of Ukraine in the sphere of counteraction crimes.
