Повідомлення про суттєві зміни в майновому стані як додатковий захід фінансового контролю за Законом України «Про запобігання корупції»

Abstract

У статті здійснено доктринальне тлумачення положень ч. 2 ст. 52 Закону України «Про запобігання корупції» у контексті повідомлення суб’єктом декларування про суттєві зміни в майновому стані. Визначено зміст понять «отримання доходу», придбання майна», «суттєві зміни в майновому стані». Розглянуто спірні питання випадків, коли суб’єкт декларування повинен повідомити Національне агентство з питань запобігання корупції про суттєві зміни в майновому стані. In the article, the doctrinal interpretation of the provisions of Part 2 of Article 52 of the Law of Ukraine «On the Prevention of Corruption» in the context of reporting by the entity of a declaration of material changes in the property state was implemented. The content of the concepts «income generation», «property acquisition», «material changes in the property state» is defined. The disputed issues of cases when the subject of declaration should inform the National Agency for the Prevention of Corruption of signifcant changes in the property state are considered.
