Короткий огляд (реферат): Дисертацію присвячено філософсько-правовому осмисленню феномена права інтелектуальної власності. Наведено історичні передумови виникнення правового регулювання використання й охорони творів науки, літератури і мистецтва, винаходів та ін. Проаналізовано проекти онтологізації інтелектуальної власності. Це, наприклад, ліберальна (теорія праці Дж. Локка), об’єктивно- ідеалістична (теорія особистості Г. Гегеля), утилітаристська (теорія максимізації загального блага Дж. Бентама та ін.). Доведено, що цінностям, які захищаються правом інтелектуальної власності, властивий квазі-об’єктивний характер. Суть використаного підходу полягає в тому, що, попри те, що цінності завжди певним чином пов’язані зі свідомістю та психікою людини, яка їх відображає (а тому для різних людей одні і ті самі предмети можуть бути носіями різних цінностей), завжди існує принципова можливість квазі-об’єктивного (відносно-об’єктивного, неабсолютного) визначення цінності певного блага в конкретній правовій ситуації з урахуванням конкретно-історичного стану розвитку суспільних відносин і балансу інтересів його учасників. За способом закріплення цінностей права інтелектуальної власності в законодавстві можна виокремити: а) безпосереднє визнання таких цінностей у цивільному законодавстві; б) створення правових засобів їхньої реалізації; в) створення правових засобів їх захисту й охорони.The thesis is devoted to philosophical and legal comprehension of the phenomenon of intellectual property rights. The historical preconditions of the emergence of legal regulation of the use and protection of works of science, literature and art, inventions, etc. are outlined. The research is based on its own methodology, which consists of conceptual approaches, general and special-scientific methods and methods of research. The work uses axiological and necessary approaches that allow us to determine what the value factors are behind certain changes in the legal regulation of intellectual property. The main problems in the field of philosophical comprehension of intellectual property, which have developed nowadays in the literature, are analyzed. So, formulating the definition of intellectual property, researchers often resort to the socalled formal-logical concept, which is based on the elemental analysis of the words «intellectual» and «property». However, our analysis based on the provisions of philology science suggests that the expression «intellectual property» is phraseological merging, that is, inseparable unity, the meaning of which can not be reduced to the usual sum of its constituent words. The projects of ontologization of intellectual property, such as liberal (J. Locke's theory of labor), objective-idealism (the theory of personality of G. Hegel), utilitarianism (the theory of maximization of the common good of J. Bentam, etc.) are analyzed. Liberal ontologization of intellectual property rights is based on the following grounds: (a) labor is a form of appropriation of objects of nature; (b) since the acquisition of property rights and intellectual property rights are natural processes, any restrictions on them must be based on grounds that are important for society; (c) the existence of a property right is determined by the limited nature of natural resources, in particular land, and for the purpose of likening intellectual property rights to objects of property rights, the former should be artificially made «rare» because of the extension of «exclusive rights» to them. Objective-idealism ontologization is based on the following: (a) freedom is constantly evolving; (b) property is the highest expression of freedom; (c) the recognition of intellectual property rights does not arise from the creation of a work (another object) itself, but through the recognition by the members of society of the right to his alienation; (d) the acquisition of intellectual property rights is the specification of its existence in society. Dialectical materialist ontologization is based on the fact that: (a) property is a social relation; (b) the division of labor and private property are forms of alienation; (c) the market allows you to assign things to the surplus that creates wealth inequality and class struggle; (d) the right deprived of autonomous content has the instrumental value for implementing the requirements of the basis; (e) hired labor, in particular workers who create intellectual property products, exists in a market economy in order to create a surplus value; (e) the ideology of intellectual property is a set of ideas about the appointment of intellectual property and its value and is a means of class struggle. Utilitarian ontologization is based on the following: (a) legal regulation is aimed at establishing a balance in order to maximize the overall benefits in society; (b) the state must provide legal means at least to reimburse the costs of expressing the author or inventor; (c) the transition from one state of the economic system to another increases overall welfare if those members of society who win in this transition are able to compensate for the loss of those whose situation worsens; (d) the balance of legal protection should contribute to increasing the initiative and purity of competition on the market. The competitor proves that the values protected by the intellectual property right are quasi-objective. The essence of our approach is that, despite the fact that values are always in some way related to the consciousness and psyche of the person who reflects them (and therefore, for different people, the same objects can be carriers of different values), there always exists the fundamental possibility of a quasi-objective (relative-objective, not absolute) definition of the value of a particular good in a particular legal situation, taking into account the concrete historical state of development of social relations and the balance of interests of its participants. By way of consolidating the values of intellectual property rights in the law, one can distinguish: (a) the direct recognition of such values in civil law; (b) the creation of legal means for their implementation; (c) the creation of legal remedies for their protection and protection. It is proved that the substantive unity of the right of intellectual property as a legal phenomenon is ensured by the transitional family similarities of objects subject to its regulation. This approach allows us to reject the metaphysical notion that all objects of intellectual property rights are inherently the same nature, and therefore one single strategy of ontology.
