Cучасні підходи до ексгумації трупа

Abstract

Показано, що експертні дії при проведенні ексгумації трупа набувають на сьогоднішній день особливої актуальності. Вони як при проведенні ексгумації трупа, так і при молекулярно-генетичному дослідженні біологічного матеріалу включають підготовчий етап, який передбачає вивчення експертом матеріалів справи, складання плану дій під час ексгумації та визначення слідчим кола осіб для участі у цій слідчій дії; власне дослідження (ексгумацію трупа та проведення його експертизи) та інтерпретацію результатів. Генетично-молекулярні дослідження біологічного матеріалу дають на даний час найбільш точні результати при ідентифікації особи. Ці методи базуються на прямому дослідженні носія спадкової інформації - ДНК. Вони дозволяють визначати мізерну її кількість у біологічному матеріалі, що робить можливим дослідження гнильно змінених і сильно фрагментованих об’єктів. Про проведену слідчу дію складається протокол, до якого додаються матеріали вимірювання, фотографування, звуко- і відеозапису, плани, схеми, відбитки та зліпки, результати лабораторних досліджень біологічного матеріалу. На основі проведеного аналізу поняття «ексгумація трупа», що широко використовується у юриспруденції, обґрунтовано доцільність його уточнення з врахуванням конкретного місця, звідки проводиться виймання трупа. Проаналізовано процесуальні підстави для проведення ексгумації трупа та роль слідчого і судово-медичного експерта на всіх етапах проведення даної слідчої дії. Констатовано, що підставою для проведення ексгумації трупа є зібрані у справі дані, які зумовлюють необхідність проведення цієї процесуальної дії та прийняття слідчим відповідного рішення. It is shown that expert actions during the exhumation of a corpse become especially relevant today. They both during the exhumation of the corpse and during the molecular genetic study of biological material include the preparatory stage, which involves the expert's study of the case materials, drawing up an action plan during the exhumation and determining the circle of persons to participate in this investigative action by the investigator; own research (exhumation of the corpse and carrying out its examination) and interpretation of the results. Genetic and molecular studies of biological material currently provide the most accurate results in identifying a person. These methods are based on the direct study of the carrier of hereditary information - DNA. They make it possible to determine its small amount in biological material, which makes it possible to study decayed and highly fragmented objects. A protocol is drawn up on the investigative action, to which are attached the materials of measurement, photography, sound and video recording, plans, schemes, impressions and casts, the results of laboratory studies of biological material. Based on the analysis of the concept of "exhumation of a corpse", which is widely used in jurisprudence, the expediency of its clarification, taking into account the specific place from where the corpse is removed, is substantiated. The procedural grounds for the exhumation of the corpse and the role of the investigator and forensic medical expert at all stages of this investigative action are analyzed. It was established that the basis for the exhumation of the corpse is the data collected in the case, which make it necessary to carry out this procedural action and make the appropriate decision by the investigator.
