Філософія діяльності сучасного поліцейського щодо забезпечення прав людини: філософсько-правовий, праксеологічний та формально-логічний аспекти

Abstract

Стаття присвячена проблемі особливостей діяльності сучасної поліції щодо забезпечення прав людини в Україні. Розкриваються філософсько-правовий (ціннісний), праксеологічний (практичний) та формально-логічний (методологічний) аспекти діяльності сучасних поліцейських. Стверджується про те, що після реформування діяльність поліції змінилася, вона перетворилася з карального органу, на той, що надає правоохоронні послуги, захищає, допомагає та підтримує суспільство. Наголошується на тому, що філософія сучасного поліцейського проявляється у його здатності сьогодні бути добрим психологом, правником, медиком, взірцем для наслідування, якісно здійснювати превентивну діяльність. Зважаючи на розмаїття українського суспільства, в статті наголошується на тому, що поліцейський окрім чинного законодавства має добре знати міжнародні нормативно-правові акти, які сприяють утвердженню забезпеченню прав людини. Виходячи з Українських реалій, сучасна правоохоронна система запровадила ініціативу Custody Records, яка передбачає запобігання порушень прав людини в ізоляторах тимчасового тримання. Custody Records передбачає комплекс заходів спрямованих на забезпечення прав людини в ізоляторі тимчасового тримання. Людина має право поскаржитися на порушення прав та свобод під час затримання. Система передбачає відео спостереження за затриманою особою, що унеможливлює завдання їй чи нею будь якої шкоди. Також запроваджується посада інспектора з дотримання прав людини, який збирає максимальну інформацію щодо затриманої особи. Стратегічним орієнтиром для сучасного поліцейського є діяльність та взаємодія з громадянським суспільством на основі принципу партнерства (Community Policing). Діяльність поліції має відповідати верховенству права, бути прозорою, відкритою, терпимою, орієнтуватися на ключові запити та потреби громади. Прикладом взаємодії поліції з населенням в українських реаліях (Community Policing), є створення консультативних груп громадян, діяльність яких спрямована на ефективне вирішення різноманітних місцевих проблем. Саме поліцейський, в сенсі забезпечення прав людини на місцях, має бути максимально інтегрованим в громаду. Важливу роль для пересічної особи відіграє якісна та компетентна кваліфікація злочинів, яка є неможливою без застосування принципів та методів формальної логіки. The article is devoted to the problem of the specifcs of the activities of the modern police in ensuring human rights in Ukraine. Philosophical-legal (value), praxeological (practical) and formal-logical (methodological) aspects of the activity of modern police ofcers are revealed. It is argued that after the reform, the activities of the police changed from a punitive body to one that provides law enforcement services, protects, helps and supports society. It is emphasized that the philosophy of a modern police ofcer is manifested in his ability to be a good psychologist, lawyer, doctor, role model, and to carry out preventive activities with quality. Taking into account the diversity of Ukrainian society, the article emphasizes that, in addition to current legislation, a police ofcer should be well-versed in international legal acts that contribute to the establishment of human rights. Based on Ukrainian realities, the modern law enforcement system has introduced the Custody Records initiative, which provides for the prevention of human rights violations in temporary detention centers. Custody Records provides for a set of measures aimed at ensuring human rights in a temporary detention facility. A person has the right to complain about violation of rights and freedoms during detention. The system provides video surveillance of the detained person, which makes it impossible to cause him or her any harm. The position of a human rights inspector is also being introduced, who collects the maximum amount of information about the detained person. The strategic orientation for a modern policeman is activity and interaction with civil society based on the principle of partnership (Community Policing). Police activities must comply with the rule of law, be transparent, open, tolerant, and focus on the key requests and needs of the community. An example of the interaction of the police with the population in Ukrainian realities (Community Policing) is the creation of advisory groups of citizens whose activities are aimed at effectively solving various local problems. It is the policeman, in the sense of ensuring human rights on the ground, who should be integrated into the community as much as possible. An important role for the average person is played by high-quality and competent qualifcation of crimes, which is impossible without the application of principles and methods of formal logic.
