Нормативно-правове закріплення повноважень поліцейських офіцерів громад у сфері адміністративно-юрисдикційної діяльності

Abstract

У даній статі проведено аналіз законодавчого закріплення повноважень поліцейських офіцерів громад Національної поліції України у сфері адміністративно-юрисдикційної діяльності. Розглянуто поняття та особливості адміністративно-юрисдикційної діяльності Національної поліції України в загальному. Визначено основні напрямки реалізації службових повноважень працівників Національної поліції України у сфері адміністративно-юрисдикційної діяльності. Визначено основні нормативно-правові акти, якими керуються у свої діяльності поліцейські офіцери громад під час реалізації повноважень у сфері адміністративно-юрисдикційної діяльності. Зазначено про основні нормативно-правові акти, положення яких використовують поліцейські офіцери громад під час здійснення адміністративно-юрисдикційної діяльності по розгляду звернень громадян. Розглянуто окремі положення Кодексу України про адміністративні правопорушення на предмет їх застосування поліцейськими офіцерами громад під час реалізації повноважень у сфері адміністративно-юрисдикційної діяльності, яка полягає у здійсненні провадження у справах про адміністративні правопорушення. Виокремлено, що адміністративно-юрисдикційна діяльність, яка полягає у здійсненні провадження (службового розслідування), поліцейськими офіцерами громад не здійснюється, виключно у випадках, якщо така діяльність може бути реалізована керівниками підрозділів взаємодії з громадами Національної поліції України відносно своїх підлеглих. Зазначено, що адміністративно-юрисдикційні повноваження поліцейських офіцерів громад в переважній більшості реалізуються під час застосування норм законодавства, які регулюють питання розгляду звернень громадян, а також під час застосування відповідних норм Кодексу України про адміністративні правопорушення в ході здійснення провадження у справах про адміністративні правопорушення. Запропоновано внести відповідні законодавчі зміни до законодавства з метою систематизації та конкретизації напрямків реалізації адміністративно-юрисдикційних повноважень поліцейських офіцерів громад Національної поліції України. In this article, an analysis of the legislative consolidation of the powers of community police ofcers of the National Police of Ukraine in the feld of administrative and jurisdictional activities was carried out. The concepts and features of the administrative-jurisdictional activity of the National Police of Ukraine in general are considered. The main areas of implementation of ofcial powers of employees of the National Police of Ukraine in the feld of administrative and jurisdictional activities have been determined. The main regulatory legal acts that guide community police ofcers in their activities during the exercise of powers in the feld of administrative and jurisdictional activities have been determined. It is noted about the main regulatory legal acts, the provisions of which are used by community police ofcers during the implementation of administrative and jurisdictional activities for consideration of citizens' appeals. Separate provisions of the Code of Ukraine on Administrative Offenses are considered for the purpose of their application by police ofcers of communities during the exercise of powers in the feld of administrative and jurisdictional activity, which consists in the implementation of proceedings in cases of administrative offenses. It is highlighted that administrative-jurisdictional activity, which consists in carrying out proceedings (ofcial investigation), is not carried out by community police ofcers, only in cases where such activity can be carried out by the heads of units of interaction with communities of the National Police of Ukraine in relation to their subordinates. It is noted that the administrative-jurisdictional powers of community police ofcers are exercised in the vast majority during the application of legislative norms that regulate the consideration of citizens' appeals, as well as during the application of the relevant norms of the Code of Ukraine on Administrative Offenses in the course of proceedings in administrative offense cases. It is proposed to make appropriate legislative changes to the normative legal act in order to systematize and specify the areas of implementation of administrative and jurisdictional powers of community police ofcers of the National Police of Ukraine.
