Abstract

Під час спільної діяльності люди обмінюються між собою різноманітними уявленнями, ідеями, інтересами, настроями, почуттями тощо. В умовах розмовної юридичної комунікації інформація не тільки передається, але й формується, уточнюється, розвивається. При цьому кожен учасник комунікативного процесу передбачає активність також і в своєму партнерові, тому, направляючи цю інформацію, повинен враховувати його інтереси, цілі, бажання. Під час взаємодії між людьми надзвичайно важливо не тільки обмінюватися інформацією, але й організовувати «обмін діями», планувати загальну діяльність. Важливою умовою активізації пізнавальних процесів в умовах розмовної комунікації являється виникнення проблемних ситуацій в результаті зіткнення полярних думок, поглядів, підходів до взаємодії. Виникає неузгодженість, яка потребує залучення додаткової інформації. Це приводить до збільшення інтенсивності взаємодії учасників спільної діяльності, активізації процесів навчання, що в свою чергу забезпечує поглиблення рівня розуміння та сприяє прийняттю правильного рішення. In the context of spoken legal communication, information is not only transmitted, but also formed, clarified and developed. At the same time, each participant in the communication process assumes activity in his or her partner, so when sending this information, he or she must take into account his or her interests, goals, and desires. During interaction between people, it is extremely important not only to exchange information, but also to organize an "exchange of actions" and plan common activities. An important condition for the activation of cognitive processes in conversational communication is the emergence of problematic situations as a result of the clash of polar opinions, views, and approaches to interaction. Inconsistencies arise that require additional information. This leads to an increase in the intensity of interaction between participants in joint activities, intensification of learning processes, which in turn deepens the level of understanding and contributes to making the right decision.
