Дозвільна система як адміністративна послуга з реалізації права на володіння вогнепальною зброєю

Abstract

У статті на підставі комплексного системного підходу розглянуто дозвільну систему у контексті адміністративних послуг із реалізації права на володіння вогнепальною зброєю. Вдосконалення державного регулювання обігу вогнепальної зброї, що поєднує питання ліцензійно-дозвільної та профілактичної діяльності, державне управління у сфері обігу зброї визначає актуальність дослідження. Об’єктом дослідження є суспільні відносини, що складаються у сфері діяльності органів виконавчої влади, уповноважених у сфері обігу зброї, щодо правил обігу вогнепальної зброї. Предметом виступають наукові дослідження у сфері діяльності виконавчої влади щодо забезпечення правил обігу вогнепальної зброї, норми права, що регулюють зазначену діяльність. Сутність дозвільної системи пов’язана з призначенням, що полягає у забезпеченні публічної безпеки. Доведено, що єдина теоретична основа реалізації адміністративних послуг органами, уповноваженими у сфері обігу зброї, щодо обігу вогнепальної зброї зумовлює внутрішньогалузевий взаємозв’язок правових норм про обіг зброї та законодавства про адміністра тивні послуги і про адміністративну процедуру. Вказано, що взаємозв’язок передбачає відповідність значення та теоретичного сенсу елементів понятійного апарату контрольно-наглядової діяльності у сфері обігу зброї значенню та теоретичному сенсу цих елементів, закріпленому спеціалізованим законодавством про адміністративні по- слуги, не допускаючи спотворення. Дозволи виступають умовами для реалізації фізичними і юридичними особами прав і законних інтересів щодо придбання, зберігання та володіння вогнепальною зброєю. Перспектива розвитку правового регулювання у сфері обігу зброї пов’язана із застосуванням інформаційно-комунікаційних технологій та удосконаленням Єдиного реєстру зброї єдиної інформаційної системи Міністерства внутрішніх справ України. The article, based on a comprehensive system approach, examines the permit system in the context of administrative services for the implementation of the right to own a firearm. Improving state regulation of the circulation of firearms, which combines issues of licensing and permitting and preventive activities, state management in the field of weapons circulation determines the relevance of the study. The object of the study is public relations that develop in the field of activity of the executive authorities authorized in the field of weapons circulation regarding the rules for the circulation of firearms. The subject is scientific research in the field of activity of the executive authorities regarding the enforcement of the rules for the circulation of firearms, the legal norms regulating the specified activity. The essence of the permit system is connected with the purpose, which is to ensure public safety. It is proved that the single theoretical basis for the implementation of administrative services by the bodies authorized in the field of arms circulation regarding the circulation of firearms determines the intrasectoral relationship of legal norms on arms circulation and legislation on administrative services and on administrative procedure. It is indicated that the relationship assumes the correspondence of the meaning and theoretical meaning of the elements of the conceptual apparatus of control and supervisory activities in the field of arms circulation to the meaning and theoretical meaning of these elements, enshrined in specialized legislation on administrative services, without allowing distortion. Permits are conditions for the implementation by individuals and legal entities of rights and legitimate interests regarding the acquisition, storage and possession of firearms. The prospect of the development of legal regulation in the field of arms circulation is associated with the use of information and communication technologies and the improvement of the Unified Register of Weapons of the Unified Information System of the Ministry of Internal Affairs of Ukraine.
