| dc.description.abstract | Колабораційна діяльність як кримінально-правове явище пройшло декілька етапів, які пов’язані з політичними, історичними обставинами. У доктрині виділено три етапи формування і реалізації кримінально-правової політики щодо колабораційної діяльності. У розвитку наукових підходів до відповідальності за співпрацю з ворогом можна виокремити три етапи, які відрізнялися ступенем наукового дослідження, рівнем правового врегулювання та практикою кваліфікації таких діянь. Поява нової норми зумовила активні та численні її дослідження. Незважаючи на такий вагомий науковий доробок, багато питань залишаються не вирішеними, дискусійними, а законодавцем досі не внесено жодних правок, доповнень до ст. 111-1 КК України. Вказане зумовлює необхідність проаналізувати роботи, які уже опубліковано, підсумувати існуючі пропозиції та виробити нові підходи для вирішення проблем кваліфікації колабораційної діяльності. На появу нових чи виокремлення з існуючих норм Кримінального кодексу України завжди впливають певні фактори. Щоб визначити такі чинники, необхідно з’ясувати, чи є норма про колабораційну діяльність вперше криміналізованою, чи вона є диференційованим різновидом «Державної зради». Підтримано позицію, що колабораційна діяльність є диференційованою формою статті «Державна зрада». Серед чинників, які впливають на законодавчу оцінку зміни ступеня суспільної небезпеки державної зради, ключовими є тривала окупація, що розпочалася ще у 2014 році, та її наслідки, які суттєво вплинули на поведінку населення й зумовили потребу у більш поміркованому підході до притягнення до відповідальності. Не менш вагомим чинником є суспільний запит на справедливість, підтверджений результатами досліджень громадської думки. Проведений аналіз об’єктів складів кримінальних правопорушень, передбачених статтею 111-1 КК України. Встановлено, що загальним об’єктом є всі суспільні відносини, які охороняються КК України і визначені у ст. 1 КК України. Щодо родового об’єкту, то ним є національна безпека. Запропоноване визначення родового об’єкту злочинів проти основ національної безпеки під яким розуміти суспільні відносини щодо забезпечення національної безпеки України. Запропоновано не виділяти видовий об’єкт злочинів проти основ національної безпеки, адже колабораційна діяльність впливає як на зовнішню так і на внутрішню безпеку держави. Безпосереднім об’єктом колабораційної діяльності є національна безпека України у сфері державної безпеки, воєнній, інформаційній та економічній сферах. Додатковими обов’язковими об’єктами є: життя особи та право власності, адже захист саме цих об’єктів передбачений у окремих нормах КК України. Інші об’єкти не можуть бути обов’язковими об’єктами колабораційної діяльності, адже такої вказівки жодна із частин статті не містить. Визначено, що до предметів колабораційної діяльності слід відносити «стандарти освіти держави-агресора» (ч. 3 ст. 111-1 КК України), «матеріальні ресурси» (ч. 4 ст. 111-1 КК України) та «інформацію» (ч. 6 ст. 111-1 КК України, п. 3 примітки). Запропоновано розуміти «стандарт освіти державиагресора» за допомогою методу доведення від супротивного, тобто від поняття стандарт освіти, який визначений українським законодавством. Відтак, слід встановити сукупність таких характеристик: 1) це один документ чи кілька документів, який (які) (2) видано державою-агресором (окупаційною адміністрацією) та спрямовано на (3) організацію освітнього процесу (4) всупереч українським стандартам (зокрема, визначених Законом України «Про освіту» та ін.). Характеристика ознак об’єктивної сторони проводилась за сферами: інформаційна, адміністративна, освітня, економічна, виборча, політична, воєнна. За результатом дослідження колабораційної діяльності в інформаційній сфері запропоновано виключити ч. 1 ст. 111-1 КК України та доповнити відповідною нормою КУпАП через те що таке діяння є проступком, завдана шкода не підриває національну безпеку, а покарання має вибірковий характер. Щодо ч. 6 ст. 111-1 КК України, запропоновано виключити вказівку на ознаку державної влади та унормувати «заклики» в одиничну форму. Посадовий колабораціонізм, який передбачений ч.ч. 2, 5, 7 КК України передбачає поетапне з’ясування: у якому органі працює особа та які функції вона виконує. Запропоновано виключити вказівку що до незаконних органів влади. У дискусії щодо покарання осіб, які займають посади у правоохоронних чи судових органах визначено, що існуюча норма тлумачиться надто широко, а тому притягнення водія чи іншої особи, яка виконує технічні функції за ч. 7 ст. 111-1 КК України є надмірним. Проаналізовано колабораційну діяльність в освітній сфері (ч. 3 ст. 111-1 КК України) та з’ясовано, що слід розуміти під впровадженням стандартів освіти країни-агресора та під пропагандою. З судової практики визначено дії, вчинення яких кваліфікується як колабораційна діяльність в освітній сфері. Зроблено висновок про те, що керівник закладу освіти який впроваджує стандарти освіти держави-агресора зазвичай одночасно вчиняє і пропаганду. Охарактеризовано колабораційну діяльність в економічні сфері (ч. 4 ст. 111-1 КК України). Запропоновано до незаконних воєнізованих формувань відносити і молодіжні організації, які передбачають ієрархію, сувору дисципліну, навчають користуватись зброєю, проводять вишколи. Розглянуто колабораційну діяльність у виборчій сфері (ч. 5 ст. 111-1 КК України). Запропоновано використовувати чинне українське виборче законодавство для розуміння етапів виборів чи референдуму, функцій спостерігачів, комісій тощо. Зроблено висновок, що політичний колабораціонізм (ч. 6 ст. 111-1 КК України) завжди підриває національну безпеку. Тож, кримінально-караними будуть не будь-які політичні заходи, а ті, проведення яких реалізує зазначену мету, і які шкодять національній безпеці України. Зазначено, що у ст. 111-1 КК України має значення місце вчинення, адже в окремих формах воно прямо зазначене (ч. 2, 3, 5, 7 ст. 111-1 КК України). В інших формах місце не зазначене, однак диктується обстановкою – умовами окупації. Отже, місцем вчинення колабораційної діяльності є повністю чи частково непідконтрольна територія України (тимчасово окупована територія, лінія зіткнення). Суб’єктом колабораційної діяльності, з огляду на спорідненість із державною зрадою запропоновано вважати фізичну осудну особа, яка досягла віку 16 років та є громадянином України. Суб’єкти колабораційної діяльності можуть також мати додаткові ознаки. Встановлено, що впроваджувати стандарти освіти держави-агресора можуть виключно особи, уповноважені окупаційною адміністрацією держави-агресора на таку діяльність та мають такі функції. Натомість, здійснювати пропаганду у закладах освіти може будьяка особа. Щодо додаткових ознак суб’єкта колабораційної діяльності то для кваліфікації діяння за ч. 4 ст. 111-1 КК України не має значення чи була взагалі особа зареєстрована як фізична особа-підприємець чи юридична особа. Запропоновано виключити вказівку на добровільність із ст. 111-1 КК України, адже вимушений колабораціонізм повинен оцінюватись як обставина, що виключає кримінальну протиправність діяння. Здійснено розмежування складів кримінальних правопорушень, передбачених статтею 111-1 КК України. Запропоновано для розмежування посадового колабораціонізму з’ясовувати 1) орган, у якому особа обійняла посаду; 2) назву посади та 3) функції, які фактично виконувала особа. Те, що особа обіймає посаду керівника не означає, що особа виконує організаційно-розпорядчі або адміністративно-господарські функції. Продовжено наукову позицію, що керівники закладів освіти не можуть нести відповідальність за ч. 5 ст. 111-1 КК України. Втім, якщо це приватний заклад, який реєструється та веде господарську діяльність спільно з державоюагресором, то такі дії можуть бути кваліфіковані за ч. 4 ст. 111-1 КК України. Проведено розмежування складів колабораційної діяльності в інформацій сфері (ч.ч. 1, 3, 6 ст.111-1 КК України) та визначено, що їх спільними ознаками є: 1) висловлення певних поглядів; 2) антиукраїнський характер; 3) публічність (хоча ця ознака прямо зазначена тільки у ч. 1 ст. 1111 КК України, однак вона притаманна ч. 3 і ч. 6 ст. 111-1 КК України); 4) співпраця з державою-агресором (ця ознака зазначена тільки у ч. 6 ст. 111-1 КК України, втім ст. 111-1 КК України завжди стосується співпраці з державою-агресором. Розмежувальними ознаками ч. 3 ст. 111-1 КК України від інших форм колабораціонізму є те, що пропаганда це системна діяльність, яка здійснюється у різний спосіб (виступи, заходи тощо), пов’язана з освітнім процесом та є орієнтованою на здобувачів освіти – дітей. Недоліком норми є те, що визначено місце – заклад освіти, яку науковці часто сприймають за розмежувальну ознаку. Однак, пропаганда може вчинятися і дистанційно і в позашкільний період та охоплюватися освітнім процесом. Розмежувальними ознаками ч. 6 ст. 111-1 КК України і ч. 1 ст. 111-1 КК України є те, що за ч. 6 ст. 111-1 КК України особа робить такі дії на замовлення, прохання, вказівкою, чи будь-яким іншим чином взаємодіє з представником держави-агресора, а за ч. 1 ст. 111-1 КК України особа це робить самостійно і один раз. Звернено увагу на розмежування ч. 6 ст. 111-1 КК України та ч. 5 ст. 1111 КК України. Запропоновано вважати ч. 5 ст. 111-1 КК України спеціальною щодо ч. 6 ст. 111-1 КК України. Заходи політичного характеру, які пов’язані з виборами мають кваліфікуватися за ч. 5 ст. 111-1 КК України. Обґрунтовано необхідність виключити з ч. 5 ст. 111-1 КК України відповідальність за «публічні заклики до незаконних виборів, референдуму». Проаналізовано позиції науковців щодо розмежування ч. 7 ст. 111-1 КК України та ч. 1 ст. 111 КК України. Підтримано позицію, що так як колабораційна діяльність є різновидом державної зради, то кваліфікація за сукупністю цих статей порушує принцип заборони двічі притягувати до кримінальної відповідальності за один злочин. Ключовою ознакою для розмежування є наявність чи відсутність умов окупації. Для розмежування колабораційної діяльності у воєнній сфері (ч. 7 ст. 111-1 КК України) та створення не передбачених законом воєнізованих або збройних формувань (ст. 260 КК України) пропонується кілька підходів. На нашу думку, такими розмежувальними ознаками є: (1) місце створення незаконних формувань – тимчасово окупована територія держави-агресора (ч.7 ст. 111-1 КК України), (2) обстановка – умови окупації (ч. 7 ст. 111-1 КК України), (3) метою створення незаконних формувань є ведення бойових чи інших дій в межах збройного конфлікту (ч. 7 ст. 111-1 КК України). Розмежування колабораційної діяльності (ст. 111-1 КК України) від терористичного акту і суміжних з цим явищем діянь (ст.ст. 258, 258-1, 258-2, 258-3, 258-4, 258-5, 258-6 КК України) теж можна здійснювати за обстановкою – умовами окупації. Наголошено на недопущенні ототожнення воєнного злочину та терористичного акту. Відмежування колабораційної діяльності (ст. 111-1 КК України) від виправдовування, визнання правомірною, заперечення збройної агресії рф проти України, глорифікація її учасників (ст. 436-2 КК України) у доктрині здійснюється за різними ознаками. Втім, вони співвідносяться як загальна та спеціальна, тож застосовуватися має спеціальна норма. Можлива і сукупність злочинів. Виготовлення, поширення комуністичної, нацистської символіки та пропаганда комуністичного та націонал-соціалістичного (нацистського) тоталітарних режимів (ст. 436-1 КК України) і колабораційна діяльність (ст. 111-1 КК України) можуть утворювати сукупність злочинів. Розмежувальними ознаками колабораційної діяльності (ст. 111-1 КК України) та пропаганди війни (ст. 436 КК України) є родовий об’єкт, предмет заклику. Доведено, що за ст. 436 КК України особа може нести відповідальність якщо збройний конфлікт ще не розпочався, а за ст. 111-1 КК України – під час існуючого збройного конфлікту. Запропоновано виключити ст. 111-2 КК України, а пособництво державі-агресора залежно від обстановки вчинення кваліфікувати за раніше прийнятими нормами. Так, якщо відповідне діяння вчинене в умовах окупації – ст. 111-1 КК України, поза межами окупації – ст. 111 КК України. Collaborative activity as a criminal-law phenomenon has undergone several stages associated with political and historical circumstances. In legal doctrine, three stages of the formation and implementation of criminal-law policy regarding collaborative activity are distinguished. In the development of scientific approaches to liability for cooperation with the enemy, three stages can also be identified, which differed in the level of scientific research, the degree of legal regulation and the practice of qualifying such acts. The emergence of the new legal provision led to numerous scholarly studies devoted to it. Despite this significant scientific contribution, many issues remain unresolved and debatable, and the legislator has still not introduced any amendments or additions to Article 111-1 of the Criminal Code of Ukraine. This situation necessitates the analysis of previously published works, the summarization of existing proposals, and the development of new approaches to addressing the problems of qualifying collaborative activity. The emergence of new provisions or the differentiation of existing norms within the Criminal Code of Ukraine is always influenced by certain factors. In order to identify such factors, it is necessary to determine whether the norm on collaborative activity constitutes a newly criminalized act or whether it is a differentiated form of the offense of «High Treason». The position is supported that collaborative activity is a differentiated form of the offence of «High Treason». Key factors influencing the legislative assessment of changes in the degree of danger posed by high treason include the prolonged occupation that began in 2014 and its consequences, which have significantly affected the behavior of the population and highlighted the need for a more balanced approach to holding individuals accountable. Another significant factor is the public demand for justice, as evidenced by public opinion research. The analysis of the elements of criminal offenses under Article 111-1 of the Criminal Code of Ukraine reveals that the general object comprises all social relations protected by the Criminal Code of Ukraine and defined in Article 1 of the Criminal Code of Ukraine. As for the generic object, it is national security. The proposes that the generic object of crimes against the foundations of national security be defined as social relations related to ensuring the national security of Ukraine. It is proposed not to distinguish a specific object of crimes against the foundations of national security, since collaborative activity impacts both the external and internal security of the state. Its direct object is the national security of Ukraine in the spheres of state, military, informational and economic security. Additional mandatory objects include the life of a person and the right to property, since the protection of these objects is ensured by separate provisions of the Criminal Code of Ukraine. Other objects cannot be considered mandatory for collaborative activity as none of the parts of the article contains such an indication. It is determined that the objects of collaborative activity should include «educational standards of the aggressor state» (Part 3, Article 111-1 of the Criminal Code of Ukraine), «material resources» (Part 4, Article 111-1 of the Criminal Code of Ukraine) and «information» (Part 6, Article 111-1 of the Criminal Code of Ukraine, paragraph 3 of the note). The concept of «educational standards of the aggressor state» is proposed to be interpreted using the method of reasoning by contradiction, starting from the concept of an educational standard as defined in Ukrainian legislation. Accordingly, the following characteristics should be established if (1) it is one document or several documents which (2) are issued by the aggressor state (occupation administration) and are aimed at (3) organizing the educational process (4) contrary to Ukrainian standards (in particular those defined by the Law of Ukraine «On Education» etc.). The characteristics of the objective elements were analyzed according to different spheres: informational, administrative, educational, economic, electoral, political, and military. As a result of the study of collaborative activity in the informational sphere, it is proposed to exclude Part 1 of Article 111-1 of the Criminal Code of Ukraine and supplement the Code of Ukraine on Administrative Offenses with an appropriate provision, since such an act constitutes a minor offense, the harm caused does not undermine national security, and the punishment is applied selectively. Regarding Part 6 of Article 111-1 of the Criminal Code of Ukraine, it is proposed to remove the reference to the feature of state authority and to standardize the term «calls» in the singular form. Official collaborationism, provided for in Parts 2, 5, and 7 of Article 111-1 of the Criminal Code of Ukraine, requires a step-by-step clarification of: in which body the person works and what functions they perform. It is proposed to remove the reference to illegal authorities. In the debate regarding the punishment of persons who hold positions in law enforcement or judicial bodies, it has been determined that the existing provision is interpreted too broadly. Therefore, bringing a driver or another person who performs technical functions to liability under Part 7 of Article 111-1 of the Criminal Code of Ukraine is excessive. Collaborative activity in the educational sphere (Part 3 of Article 111-1 of the Criminal Code of Ukraine) was analyzed, and it was clarified what should be understood by the implementation of the educational standards of the aggressor state and by propaganda. Based on judicial practice, actions the commission of which is classified as collaborative activity in the educational sphere were identified. It was concluded that the head of an educational institution who implements the educational standards of the aggressor state usually simultaneously engages in propaganda. Collaborative activity in the economic sphere (Part 4 of Article 111-1 of the Criminal Code of Ukraine) was characterized. It is proposed that illegal paramilitary formations should include organizations or camps that involve hierarchy, strict discipline, training in the use of weapons and the conduct of military-style training exercises. Collaborative activity in the electoral sphere (Part 5 of Article 111-1 of the Criminal Code of Ukraine) was examined. It is proposed to use the current Ukrainian electoral legislation to understand the stages of elections or referendums, the functions of observers, commissions and other relevant bodies. It is concluded that political collaborationism (Part 6 of Article 111-1 of the Criminal Code of Ukraine) always undermines national security. Therefore, not all political events will constitute criminally punishable acts, but only those whose organization serves the specified purpose and harms the national security of Ukraine. It is noted that the place of commission is significant in Article 111-1 of the Criminal Code of Ukraine, since in some forms it is directly indicated (Parts 2, 3, 5, and 7 of Article 111-1). In other forms, the place is not specified, but is dictated by the circumstances – namely, the conditions of occupation. Thus, the place of commission of collaborative activity is the territory of Ukraine that is fully or partially beyond government control (temporarily occupied territory or the line of contact). The subject of collaborative activity, considering its similarity to treason, is proposed to be defined as a natural, sane person who has reached the age of 16 and is a citizen of Ukraine. Subjects of collaborative activity may also possess additional characteristics. It has been established that the implementation of the educational standards of the aggressor state may be carried out exclusively by persons authorized by the occupation administration of the aggressor state to conduct such activities and who perform the relevant functions. At the same time, propaganda in educational institutions may be carried out by any person. Regarding additional characteristics of the subject of collaborative activity, for the qualification of an act under Part 4 of Article 111-1 of the Criminal Code of Ukraine, it does not matter whether the person was registered as an individual entrepreneur or as a legal entity. t is proposed to remove the reference to voluntariness from Article 111-1 of the Criminal Code of Ukraine, since forced collaborationism should be assessed as a circumstance that excludes the criminal unlawfulness of the act. A differentiation of the elements of criminal offenses provided for in Article 111-1 of the Criminal Code of Ukraine has been carried out. It is proposed that, in order to distinguish official collaborationism, the following should be clarified: 1) the body in which the person held a position; 2) the title of the position; and 3) the functions actually performed by the person. The fact that a person holds a managerial position does not necessarily mean that the person performs organizationaladministrative or administrative-economic functions. The scholarly position that heads of educational institutions cannot bear liability under Part 5 of Article 111-1 of the Criminal Code of Ukraine has been further developed. However, if it concerns a private institution that is registered and conducts economic activity jointly with the aggressor state, such actions may be qualified under Part 4 of Article 111-1 of the Criminal Code of Ukraine. A distinction has also been made between the elements of collaborative activity in the informational sphere (Parts 1, 3, and 6 of Article 111-1 of the Criminal Code of Ukraine). Their common features have been identified as: 1) the expression of certain views; 2) an anti-Ukrainian character; 3) publicity (although this feature is explicitly stated only in Part 1 of Article 111-1, it is also inherent in Parts 3 and 6 of Article 111-1); 4) cooperation with the aggressor state (this feature is explicitly mentioned only in Part 6 of Article 111-1; however, Article 111-1 of the Criminal Code of Ukraine always concerns cooperation with the aggressor state). The distinguishing features of Part 3 of Article 111-1 of the Criminal Code of Ukraine from other forms of collaborationism are that propaganda constitutes a systematic activity carried out in various ways (speeches, events, etc.), is connected with the educational process and is oriented toward recipients of education – children. A shortcoming of the provision is that it specifies the place – the educational institution – which scholars often perceive as a distinguishing feature. However, propaganda may also be carried out remotely and outside the formal school period while still being part of the educational process. The distinguishing features between Part 6 of Article 111-1 of the Criminal Code of Ukraine and Part 1 of Article 111-1 are that under Part 6 a person performs such actions upon request, instruction or any other form of interaction with a representative of the aggressor state, whereas under Part 1 a person performs such actions independently and as a single act. Attention is also drawn to the distinction between Part 6 of Article 111-1 and Part 5 of Article 111-1 of the Criminal Code of Ukraine. It is proposed to consider Part 5 of Article 111-1 as a special provision in relation to Part 6 of Article 111-1. Political events related to elections should therefore be qualified under Part 5 of Article 111-1 of the Criminal Code of Ukraine. The necessity of excluding liability for «public calls for illegal elections or referendums» from Part 5 of Article 111-1 of the Criminal Code of Ukraine is substantiated. Scholarly positions regarding the distinction between Part 7 of Article 111-1 of the Criminal Code of Ukraine and Part 1 of Article 111 of the Criminal Code of Ukraine were analyzed. The position is supported that, since collaborative activity is a type of treason, qualification under both provisions simultaneously violates the principle prohibiting double criminal liability for the same offense. The key distinguishing feature is the presence or absence of conditions of occupation. To distinguish collaborative activity in the military sphere (Part 7 of Article 111-1 of the Criminal Code of Ukraine) from the creation of paramilitary or armed formations not provided for by law (Article 260 of the Criminal Code of Ukraine), several approaches are proposed. In our view, the distinguishing features are: (1) the place where the illegal formations are created – the temporarily occupied territory controlled by the aggressor state (Part 7 of Article 111-1 of the Criminal Code of Ukraine); (2) the circumstances – conditions of occupation (Part 7 of Article 111-1 of the Criminal Code of Ukraine); (3) the purpose of creating the illegal formations – the conduct of combat or other actions within the framework of an armed conflict (Part 7 of Article 111-1 of the Criminal Code of Ukraine). The distinction between collaborative activity (Article 111-1 of the Criminal Code of Ukraine) and a terrorist act and related offenses (Articles 258, 258-1, 2582, 258-3, 258-4, 258-5, and 258-6 of the Criminal Code of Ukraine) can also be made based on the circumstances – namely, the conditions of occupation. Emphasis is placed on preventing the conflation of war crimes with acts of terrorism. The distinction between collaborative activity (Article 111-1 of the Criminal Code of Ukraine) and the justification, recognition as lawful, or denial of the armed aggression of the Russian Federation against Ukraine, as well as the glorification of its participants (Article 436-2 of the Criminal Code of Ukraine), is made in legal doctrine according to various criteria. However, these provisions are related as general and special norms; therefore, the special norm should be applied. A concurrence of crimes is also possible. The production and dissemination of communist or Nazi symbols and the propaganda of the communist and national-socialist (Nazi) totalitarian regimes (Article 436-1 of the Criminal Code of Ukraine) and collaborative activity (Article 111-1 of the Criminal Code of Ukraine) may constitute a concurrence of criminal offenses. The distinguishing features between collaborative activity (Article 111-1 of the Criminal Code of Ukraine) and propaganda of war (Article 436 of the Criminal Code of Ukraine) are the generic object and the subject of the call. It is established that under Article 436 of the Criminal Code of Ukraine a person may incur criminal liability even if an armed conflict has not yet begun, whereas Article 111-1 of the Criminal Code of Ukraine applies during an existing armed conflict. It is proposed to repeal Article 111-2 of the Criminal Code of Ukraine and to qualify aiding the aggressor state, depending on the circumstances of the act, under previously adopted provisions.
