Правове регулювання надання поліцейським щорічної відпустки

Abstract

Досліджено особливості порядку надання поліцейським щорічних відпу- сток. Виокремлено проблеми правового регулювання цього інституту трудово- го права. Щорічна відпустка поліцейського поділяється на основну і додаткову. Зауважено, що поліцейські не можуть претендувати на додаткові щорічні відпустки за особливий характер праці та у зв’язку з ненормованим робочим днем. Недостатньо врегульованим на законодавчому рівні є питання про поря- док відкликання поліцейського з щорічної відпустки. Запропоновано внести зміни до Закону України «Про Національну поліцію», зокрема стосовно виплати грошової компенсації у разі звільнення поліцейського за всі невикористані ним дні щорічної відпустки не лише в поточному, а й у минулих роках. The article deals with the peculiarities of the procedure for providing police with annual vacation. The problems of legal regulation of the institute of labor law are singled out. An annual police officer’s vacation is divided into basic and additional. Under current law, the police can not claim additional annual vacation for a special nature of work and due to an irregular working day. Therefore, it is expedient in the Law of Ukraine «On National Police» to provide a legal norm that would guarantee the police the right to additional vacation in connection with the work with harmful, dangerous and difficult conditions of service, for the special nature of the service, for the non-standardized mode of service. Holidays that are not used by police during the work year can be used by them next year. If the employee has not used his right to annual vacation in the past year or several previous years, he has the right to use it. The provisions of the Law of Ukraine «On National Police» regarding the payment of police compensation for unused days of annual vacation are not perfect. The author proposed amendments to the Law of Ukraine «On the National Police», in particular regarding the payment of monetary compensation in the case of the release of a police officer for all unused days of annual vacation not only in the current, but also in past years. Police vacation is drawn up by issuing an order. The form of the order (decree) on granting a vacation to the employee is governed by a definite standard form of the document. The policeman is familiarized with the content of the vacation order bearing the signature, as affirmed by the content of this typical form. If the order (decree) relates to several persons, it should be accompanied by a sheet of familiarization of employees with its content.
