Системне тлумачення кримінального закону: автореферат

Abstract

Дисертація присвячена комплексному дослідженню системного тлумачення кримінального закону. Проаналізовано системні та системоутворюючі зв’язки кримінального закону. На основі системного аналізу наукових джерел сформульовано поняття системного тлумачення кримінального закону, проаналізовані його істотні та неістотні ознаки. Досліджено співвідношення системного тлумачення кримінального закону з іншими способами тлумачення. Обґрунтовано можливі прийоми та правила системного тлумачення кримінального закону, охарактеризовано особливості застосування таких правил. Зауважено, що на даному етапі розвитку системи законодавства необхідно використовувати системне тлумачення кримінального закону у комплексі з іншими способами. The dissertation deals with the complex research of the system interpretation of the criminal law. The system and system-forming relations of the criminal law are analyzed. The concept of the system interpretation of the criminal law is formulated on the basis of the system analysis of the scientific resources; its significant and insignificant features are analyzed. The correlation of the system interpretation of the criminal law with other ways of interpretation is investigated. The possible methods and rules of the system interpretation of the criminal law are grounded, the peculiarities of the application of such rules are characterized. At is also said that at the modern stage of the development of the legislation system it is necessary to use the system interpretation of the criminal law combined with other methods.
