Організаційно-правові аспекти системи соціально-економічного партнерства в Україні

Abstract

Розглянуто стан нормативно-правового та інституційного забезпечення соціально-економічного партнерства в Україні. Визначено проблемні питання його становлення, зокрема суперечливість законодавчого та організаційного поля, відсутність соціального діалогу, відповідно, балансу інтересів держави і приватного інвестора, та єдиних підходів до формування системи звітності за виконанням укладених договорів соціально-економічного партнерства. З’ясовано, що для практичного запровадження і розвитку системи соціально-економічного партнерства потрібно проведення цілеспрямованої послідовної державної політики, напрямленої на формування сприятливого клімату для розроблення й реалізації проектів соціально-економічного партнерства. This article makes a case for the necessity of formation of the institution of socio-economic partnership. Socio-economic partnership is defined as a system of predominantly long-term relations between public authorities, businesses, labour groups, and the community that aims to unite the available resources (tangible, intangible, financial, intellectual, informational, labour etc.) in order to improve the effectiveness of implementation of specific tasks or projects, taking into account the interests of all the partners and achieving economic and social impact as a result of such interaction. It has been established that, for practical implementation and development of socio-economic partnership, it is requisite to implement a focused coherent public policy tailored to create a favourable environment for the development and implementation of socio-economic partnership projects, namely, through: – improving the legal framework governing socio-economic partnership, outlining definitions of basic concepts and aligning certain provisions; – improving institutional support for socio-economic partnership so as to clearly define the powers of the authorities that are involved throughout all the stages of preparation and implementation of relevant projects at the national, regional and local levels to eliminate overlapping functions; – enhancing safeguards for the protection of interests of all the parties to socio-economic partnership through the development of a mechanism for compensation and sanctions in the event of early termination of the contract or improper performance of obligations; – provisions for benefits to a private party of socio-economic partnership under certain circumstances on the part of fiscal or tariff regulatory bodies; – forming approaches to reporting on the results of socio-economic partnership and development of a methodology for assessing the economic and social efficiency of such partnership.
