Про ознаки, що кваліфікують злочин, які можуть регламентуватися в загальній частині законодавства про кримінальну відповідальність

Abstract

На основі вивчення змісту найбільш вживаних у КК України ознак, що кваліфікують злочин, а також їх впливу на суспільну небезпечність злочину, обґрунтовано перелік ознак, які можуть бути регламентовані в Загальній частині Кримінального кодексу України. За результатами дослідження доведено можливість регламентації таких ознак, як вчинення злочину повторно, групою осіб, за попередньою змовою групою осіб, організованою групою, службовою особою, шляхом зловживання службовим становищем, значні, великі та особливо великі розміри предмета злочину або шкоди, заподіяної злочином, вчинення злочину щодо двох або більше осіб, щодо неповнолітнього та щодо малолітнього, з корисливих мотивів, а також загально небезпечним способом. According to the analysis of the current Criminal Code of Ukraine, the most widespread qualificatory features are perpetration of crime repeatedly, by a group of persons, by prior conspiracy of a group of persons, by organized group, terrible and other terrible consequences, loss of life and death of man, committal of a crime due to malfeasance in office, large and extra-large sizes of the object of the crime, considerable, great, and especially great harm, concerning two or more (a few) persons, under conditions of the special period, with the exception of martial law, under conditions of martial law, in field conditions, concerning minors and infants, with lucrative impulse, by arson, explosion and another general dangerous way. It is proved that it is not advisable to apply in the general part of the Criminal Code of Ukraine such features as terrible and other terrible consequences, loss of life and death of man, under conditions of the special period, with the exception of martial law, under conditions of martial law, in field conditions. Based on peculiarities of the impact on the social danger of crime, it is substantiated the possibility of differentiation of criminal liability in the general part in cases of: willful crime committed repeatedly, as well as by a group of persons, by prior conspiracy of a group of persons and by organized group; considerable, large and particularly large object or damage caused by a crime, the obligatory feature of the essential elements of which is an object that may have different quantitative value or may cause property damage; commission of crime connected with the use of violence, causing harm to the life or health of the victim and implicating persons in illegal activities concerning two or more persons, a minor and an infant; perpetration of crime in general dangerous way; prevarication by an official; commission of crime with lucrative impulses that is not connected with acquisition of property or other items for the benefit of a person.
