Аксіологія юридичної практики

Abstract

Розглянуто юридичну практику як філософську категорію. Досліджено вплив системи цінностей субʼєктів правового процесу як частини цілісної системи філософських категорій, які утворюють систему філософського знання, на його результат, а також вплив ціннісної парадигми особи на результат її професійної діяльності. Акцентовано на природі цінностей загалом і правових цінностей зокрема та їх вплив на формування особистості. Вивчено природу юридичних помилок та ймовірні шляхи їх виправлення. Зрезюмовано, що цінність юридичної практики полягає в тому, що вона здатна заповнювати прогалини у праві, усувати суперечності, вирішувати антиномії та впливати на наявний у суспільстві досвід. Law practice is considered as a philosophical category. The influence of the value system of the subjects of the legal process as a part of the integral system of philosophical categories that form the system of philosophical knowledge, its result, as well as the influence of the value paradigm of a person on the result of his professional activity is investigated. The study of legal practice as a segment of the legal system based on its value characteristics is carried out. As a philosophical category, value is produced in the process of human socio-historical practice and reflects reality in specific historical conditions. It is emphasized that in all types of legal practice, at all its stages, the role of persons who consider, interpret, make decisions and fulfill the requirements is determined. At the same time, these individuals are usually guided by their own dominant values, because people generally perceive, assess, analyze and respond to all phenomena and events that occur with it and around it, in view of its own system of value orientations. Particular attention is paid to the nature of values in general and legal values in particular and their influence on the formation of personality. Legal values arrange, comprehend, evaluate legal validity. They are associated with the truth, with the understanding of the ideal in the right. Legal values make sense to legal life. The nature of legal errors and possible ways of their correction are considered. It is summarized that legal practice as a sphere of human activity is influenced by the system of values of its subjects, and the desired social or personal result to which the activity is directed depends on this system. At the same time, the value of legal practice is that it is able to fill gaps in the law, eliminate contradictions, resolve antinomies and influence the existing experience in society.
