Трансплантація органів від умерлої особи: проблеми правового регулювання

Abstract

Досліджено правове регулювання трансплантації органів від умерлої особи. Проаналізовано низку чинників, які безпосередньо впливають на стан правового забезпечення у цій сфері. Насамперед серед таких чинників вио- кремлено соціально-економічний рівень розвитку суспільства, зокрема еко- номічну ситуацію в державі, також рівень досконалості законодавчої бази, рівень правової культури громадян, рівень правової свідомості суб’єктів пра- возастосовної діяльності та багато інших. Здійснено порівняння поглядів сучасних зарубіжних та вітчизняних до- слідників, нормативно-правових актів, які містять поняття та характерис- тику цього явища. Узагальнено позитивний зарубіжний досвід, що може бути використаний в Україні у сфері трансплантації. Вивчено різні моделі регулю- вання донорства органів і тканин від померлих осіб. The article deals with the analysis of legal regulation of transplantation of organs from a deceased person. A number of factors that directly affect the state of legal provision in this sphere are analyzed. First of all, these factors concern the socio-economic level of development of the society, including the economic situation in the country, the level of perfection of the legislative framework, the level of legal culture of citizens, the level of legal conscience of subjects of law enforcement activity and others. Comparison of the views of modern foreign and domestic researchers, normative and legal acts that contain the concept and characteristics of this phenomenon is carried out. The positive foreign experience, which can be used in Ukraine in the field of transplantation, is analyzed. Different models of regulating the donation of organs and tissues from deceased persons are investigated. Actively participating in the reform processes, in particular in the field of European integration, our state takes a considerable number of important sociopolitical decisions that directly affect the interests of every average Ukrainian. It is not necessary to neutralize the fact that the revision of the existing legal institutions in Ukraine is urgently needed and it aims at achieving social effect, because our future depends on the decision taken today. Undoubtedly, you need to understand that if you do not think about politics, then politicians think about you. Therefore, the reform of the medical system has become one of the main problems in the social sphere for the years of independence, where there is low, sometimes even criminal professionalism, total corruption and fear of the ordinary citizen to seek medical help. This reform predetermines the introduction of qualitatively new attitude of the society and state towards medicine in general. Choosing a course of reform processes, first it requires the assertion of the legitimate rights, freedoms and interests of man and citizen. Transplantation of organs from a deceased person in the context of the appropriate research occupies an important place, because it is the most controversial component of medical reform and it requires a comprehensive study. The problems of reforming the medicine in the field of transplantation are reflected in the works of such scholars as H. Anikina, A. Antonenko, M. Avdeiev, V. Halai, V. Hlushkov, I. Seniuta, N. Malein, A. Musiienko, S. Tykhonov, L. Shapoval and many other scientists.
