Теоретико-прикладні проблеми встановлення моменту закінчення злочину: автореферат

Abstract

Дисертація містить комплексне дослідження питань сутності та особливостей встановлення моменту закінчення злочину. Відповідно до поставленої мети в роботі проаналізовано стан наукової розробки проблеми, піддана оцінці правильність та точність нормативного поняття закінченого злочину, розглянуто зміст закінченого злочину та значення правильності його встановлення для вирішення конкретних кримінально-правових питань, запропоновано критерій розмежування закінченого та незакінченого злочину, з’ясовано обставини, які впливають на встановлення моменту закінчення злочину, на їх основі класифіковано злочини за моментом їх закінчення, визначено особливості встановлення моменту закінчення злочинів різних видів та сформулювало відповідні теоретичні положення. На основі проведеного дослідження сформульовано пропозиції щодо удосконалення кримінального законодавства України та рекомендації для сучасної правозастосовної практики.In the dissertation complex research of questions of essence and features of an establishment of the moment of the termination of a crime contains. According to an object in view in work the condition of scientific working out of a problem is analysed, the estimation of correctness and accuracy of standard concept of theended crime is given, the maintenance of the ended crime and value of correctness of its establishment for the decision of concrete criminally-legal questions is considered, the criterion of differentiation of the finished and not finished crime is offered, circumstances which influence an establishment of the moment of the termination of a crime are found out and on their basis crimes on the moment of their termination are classified, features of an establishment of the moment of the termination of crimes of different kinds are defined and has formulated corresponding theoretical positions. On the basis of the carried out research offers concerning improvement of the criminal legislation of Ukraine and the recommendation for modern practice of application of the right experts are formulated.
