Напрями реформування місцевого самоврядування

Abstract

Визначено такі основні проблеми місцевого самоврядування в Україні: практично не використовується основний принцип самовизначення та самоорганізації територіальної спільноти; поточна політична система України не пристосована до розвитку місцевої демократії та самоврядування. Доведено, що децентралізація влади потребує визначення територіальної основи місцевого самоврядування та чіткого розмежування повноважень між органами виконавчої влади і органами місцевого самоврядування. The following basic problems of local self-government in Ukraine are determined: the main principle of self-determination and self-organization of territorial community are not used; the current political system of Ukraine is not adjusted to the development of local democracy and selfgovernment. International experience is described in relation with practice of partnership between state power, local self-government and non-state organizations which function on this territory. International practice shows that efficiency of local self-government is possible only with presence of the legally established rights and functions of local self-government authorities. Concerning the question of local self-government there is an obvious dissonance between state political, administrative and managerial expedience and pragmatic necessities of local communities, between institutional interests of the state and interests of local population. It is proved that decentralization of power needs determination of territorial basis of local self-government and clear delimitation of powers between bodies of executive power and local self-government authorities. The system of effective public power should be created due to the complex conduct of local self-government reform and the reform of administrative-territorial system. At local level the acceptance of administrative decisions must foresee the combination of decisions of state machine and technology of local self-government on the basis of partnership.
