Кримінально-правова характеристика складу опору особам, наділеним владними повноваженнями: автореферат

Abstract

У дисертації міститься комплексне дослідження кримінально-правової характеристики складу опору представникові влади, працівникові правоохоронного органу, державному виконавцю, члену громадського формування з охорони громадського порядку і державного кордону або військовослужбовцеві. Здійснено аналіз становлення та розвитку кримінальної відповідальності за опір особам, наділеним владними повноваженнями. Сформульовано поняття опору, його ознаки, способи вчинення цього діяння. Детально розкрито об’єктивні та суб’єктивні ознаки складу злочину, передбаченого ст. 342 КК, у тому числі кваліфікуючі. Визначено співвідношення складу опору із суміжними складами злочинів та однорідними адміністративними правопорушеннями.In the thesis are involved the complex research of criminal legal characteristic the composition of resistance to representative of power, law enforcement official, state executive official, member of non-government formation for maintenance of public order and state border or military serviceman. It is realized analyse of formation and development the criminal responsibility for resistance to persons, who are dispensed of authoritative powers. In the thesis are formulated the definition of resistance, its characteristic features, manners of making this action. It is discovered in detail objective and subjective features of composition the crime, which is foreseen by article 342 Criminal Code of Ukraine, and qualificatory features too. It is determined correlation composition of resistance with adjoining compositions of crimes and similar administrative offences
