Правові форми реалізації місцевих ініціатив

Abstract

Розглянуто стан функціонування місцевих ініціатив, які є інструментом, що дає змогу реалізовувати потреби громадян і доповнює вже наявні інструменти для покращення їх життя та добробуту. Вони виконуються районними радами за рахунок місцевого бюджету. В межах своєї мети жителі подають ідеї та заявляють про свою участь у її впровадженні, що може здійснюватися у формі внеску в натуральній, фінансовій та соціальній роботі. Встановлено, що місцеві ініціативи реалізуються відповідно до вибраних громадських проблем, які органи місцевого самоврядування мають забезпечувати відповідно до Закону України «Про місцеве самоврядування». Органи місцевого самоврядування, визначають порядок та критерії оцінки заяв на виконання громадських потреб у рамках місцевої ініціативи. Критерії оцінки повинні враховувати насамперед внесок соціальної роботи в реалізацію місцевої ініціативи. Local initiatives are an instrument that enables citizens to fulfill their needs, which complements already existing instruments for improving their living and welfare, realized by local councils at the expense of the local budget. Within their needs, citizens submit theirs ideas and declare their participation in its implementation, which may take the form of in-kind, financial or social work contributions. The local initiatives are realized according to the selected public problems that local governments must provide in keeping with the the law of Ukraine «About local self-municipality». Local government of the each region, determine the procedure and criteria for evaluating applications for public needs in the framework of a local initiative. Evaluation criteria should take into account, first of all, the contribution of social work to the implementation of the local initiative. of a territorial community. Failure to take appropriate decision to support a local initiative by the local council of deputies de facto deprives residents of the possibility of implementing ideas, but the non-participation of representatives of local governments in voting for one or another initiative does not result in the deputy of the local council of responsibility. The issue that may take an influence for the scale of tasks performed on a local initiative is the definition of the amount provided by local governments for their implementation. The lack of appropriate decisions in many local governments may be linked to the conviction that the adoption of such a decisions, and, consequently, the implementation of possible projects, will result in budget costs of the local governments. Supporting of local initiatives will allow local communities and local authorities to establish partnerships, hear and understand local needs, and ensure that citizens are aware of their ability to influence their own welfare. Implementation of the local initiative involves cooperation between citizens and local authorities. The important thing is a contribution of the applicants to the preparation of a local initiative (for example, the free preparation of an investment project by one of the applicants, who is the professionai architect), financial or material contribution (transfer of part of building materials).
