Принцип «non bis in idem» у кримінальному праві України: автореферат

Abstract

У дисертації міститься комплексне дослідження принципу «non bis in idem» у кримінальному праві України. Аналізуються ознаки принципу «non bis in idem» та його зміст, визначено місце цього принципу у системі принципів кримінального права України. Розглядається взаємодія між принципом «non bis in idem» та іншими кримінально-правовими принципами. Досліджуються правила кваліфікації злочинів, які запропоновані наукою кримінального права, на відповідність їх принципові «non bis in idem». З’ясовується значення принципу «non bis in idem» для правотворчої та правозастосовної діяльності. У результаті обґрунтовується кримінальноправова приналежність принципу «non bis in idem», розкривається його зміст. Пропонуються практичні рекомендації врахування принципу «non bis in idem» під час здійснення кримінально-правової кваліфікації злочинів та у законотворчому процесі.The thesis contains a comprehensive study of the principle «non bis in idem» in criminal law of Ukraine. Analyzes the characteristics of the principle «non bis in idem» and its contents, determines the place of this principle in the system of criminal law of Ukraine principles. We consider the interaction the principle «non bis in idem» and other principles of criminal law. We study the rules of qualification the crimes proposed science of criminal law, in conformity to the principle «non bis in idem». It turns out the value of the principle of «non bis in idem» for lawmaking and enforcement activities. The result proved that the principle «non bis in idem» is a principle of criminal law, disclosed its contents. We offer practical recommendations taking into account the principle «non bis in idem» when making qualification of crimes and in the legislative process.
