Стан формування адміністративно-правового забезпечення безпеки суб’єктів господарювання в Україні та напрями його вдосконалення

Abstract

Проаналізовано проблемні питання формування адміністративно-правового забезпечення безпеки суб’єктів господарювання в Україні. Визначено принципи діяльності ефективної системи адміністративно-правового забезпечення безпеки суб’єктів господарювання. Доведено, що безпека суб’єктів госпо- дарювання повинна мати характер самоорганізації, яка полягає в необхідності створення належних умов вільного розвитку недержавного сектора безпеки. Досліджено та запропоновано напрями державної політики в зазначеній сфері. The article deals with the problems of forming administrative and legal security of economic entities in Ukraine based on theoretical and practical aspects of economic development. The study of these problems proves that the existing means of public and legal regulation and traditional methods of administrative and legal security of economic entities in the current situation are not enough effective and even unacceptable for the protection of the legitimate interests of the economic activity. The changes of the modern conditions of functioning of economic activity stipulates the need for the development and implementation of modern methods and ways of realizing principal policies for economic entities to guarantee their competitiveness. The principles of functioning of the system of administrative and legal security of subjects are determined. The security of economic entities should have the character of self-organization; this is the need to create appropriate conditions for the free development of the non-governmental sector of security. The ways of the State policy in the sphere of security aimed at the development of economic activity, which is an integral component of national security and economic growth of statehood are investigated and proposed. The reasons and conditions of the unsatisfactory state of the security of economic entities are inconsistency of the national legislation, lack of the necessary adjustment of law enforcement, organizational weakness of the mechanisms for coordination of the interests of the State and the entities, imperfection of the institution of economic perils insurance, lack of qualified legal advice, etc. It is necessary to establish an effective system of public-legal regulation in order to improve the mechanism of administrative-legal providing safety of the economic subjects, which should be carried out through the development of legal standards, the creation of the necessary machinery to facilitate their activities and control. We consider that state, non-governmental law enforcement agencies and public institutions this process should take an active part in this process.
