Поняття державної служби в правоохоронній сфері України

Abstract

Досліджено поняття «державна служба в правоохоронній сфері». Проаналізовано його смислове значення й юридичну сутність у контексті діяльності правоохоронних органів. З позиції системного аналізу розглянуто керуючу та керовану підсистеми державної служби в правоохоронній сфері, їх динамічні (функції), статичні (структуру), компетенційні (права, обов’язки, відповідальність) складові відповідно до напряму європейської інтеграції. The article deals with the concept of public service in the law enforcement field. The connotation and legal essence of the state service in the law enforcement sphere in the context of the activities of law enforcement agencies are analyzed. The main purpose of the state service in the law enforcement field is to provide the internal functioning of law enforcement agencies and attaining external objectives of the state to protect individuals, society and the state from illegal encroachments. The goal of the public service in the law enforcement sphere as an external expression of law enforcement allows you to consider it as a special form of law enforcement and separate from other types of public service. The state service in the law enforcement sector as an organizational system includes various elements which form the administrative (subject of administration) and controlled (object of administration) subsystems. This feature of the civil service in the law enforcement sector is stipulated by the theoretical understanding of the internal essence of social control systems. Administrative subsystem consists of bodies of State Authority of general, branch and special competence. Controlled subsystem includes officials of the public service in the law enforcement sphere – officials of the state bodies of law enforcement. Availability of administrative and controlled subsystems of the public service in the law enforcement field determines their dynamic (function), static (structure), competence rights, obligations, responsibility) components. Dynamics is expressed in the direct implementation of the external directions of law enforcement, as well as in the field of intra-organizational activities of law enforcement bodies, including their staffing. Statics of the public service in the law enforcement field is represented by the entities that make up its administrative and controlled subsystems. All three of these components form an integral and organizational legal form of public service in the law enforcement sphere as a socio-legal system.
